A few days ago, a client asked me: “Madam, mere case ka naam toh register mein hai… kya yeh wahi land record hota hai jo Patwari rakhta hai?” This is a very common confusion. People often mix up Civil Registers with Revenue Records, but in reality, they serve very different purposes 👇 1️⃣ Civil Case Register Maintained by the court Records details of cases filed (plaintiff, defendant, case number, next date, stage of case) Helps track the progress of litigation Example: A partition suit between brothers is entered in the Civil Register of the District Court. 2️⃣ Revenue Record Maintained by the Revenue Department (Patwari, Tehsildar, Kanungo) Contains details of land ownership, cultivation, and rights Used for property transactions, land disputes, and mutation Example: The Khasra/Khatauni/Jamabandi showing who owns which piece of land. McPatel Foods has filed a civil suit in an Ahmedabad rural court against McDonald’s, challenging what it terms “groundless threats” tied to McDonald’s objection over the use of the prefix “Mc” in its brand name, “McPatel.” McPatel applied to register the trademark in March 2024, covering a range of processed food products. McDonald’s filed a formal objection in August 2024, claiming the “McPatel” mark causes deceptive similarity with its established “Mc” family of trademarks. McDonald’s insists that the prefix has acquired global distinctiveness over decades of use, beginning in India in 1996.  McPatel’s counter statement argues that: - Its name stems from a registered corporate identity and carries no intent to mislead - There is no evidence of confusion or consumer deception - The trademark registry had initially accepted the mark after examination - The opposition appears motivated by business rivalry rather than genuine legal injury  The suit uses Section 142 of the Trade Marks Act, a legal route to stop unwarranted threats.  This dispute isn’t just about marketing or naming. It tests the limits of trademark scope in India. Can a multinational claim exclusive rights over a prefix that appears in many Indian brand identities?
