Ukraine adopts EU standards with new regulation of industrial pollution On 16 July 2024, the Ukrainian Parliament adopted the Law of Ukraine No. 3855-IX “On Integrated Prevention and Control of Industrial Pollution” as part of Ukraine`s commitments under the Association Agreement with the EU. The Law introduces integrated approach to permitting procedures and the control of industrial pollution based on the application of the Best Available Techniques (BAT) and management methods in accordance with EU Directive 2010/75/EU of 24 November 2010 on industrial emissions (i.e. integrated pollution prevention and control). Ukraine launches 2025 privatisation of Odesa Portside Plant JSC: key issues for bidders The State Property Fund of Ukraine has opened the pre-sale process for the long-awaited disposal of 99.5667% of the share capital of JSC Odesa Portside Plant (OPP), a transaction scheduled to be awarded by electronic auction on 25 November 2025. Situated at Pivdenne on the Black Sea coast, OPP is one of the country’s largest chemical complexes, which has produced ammonia, urea and industrial gases and operating deep-water terminals capable of loading Panamax-size vessels. Core production was suspended following Russia’s invasion, but OPP has continued to generate limited income by supplying oxygen and nitrogen and acting as a port logistics hub. Against the backdrop of Ukraine’s post-war reconstruction agenda, the sale promises to be the headline asset in the 2025 large-scale privatisation calendar. Ukraine adopts new procedure for borrowing and guarantees for state-owned companies Ukraine has adopted a new procedure for state-owned companies and enterprises (SOEs) to authorise borrowing and provide guarantees, which modernises the borrowing authorisation process. Specifically, the new procedure mandates a new approval structure for external, domestic long-term, and domestic short-term borrowing, and guarantees and suretyships. For SOEs, the key improvements include reducing the decision-making timeframe from 30 to 20 business days and allowing the submission of digital documents. While the Ministry of Finance (MoF) retains authority over external and long-term domestic loans, the Authorised State Agencies are now empowered to directly approve domestic short-term borrowing of SOEs. Furthermore, SOEs are no longer required to provide an extract from the Unified State Register, although the MoF now requires an economic justification for any transaction. Ukraine passes draft law improving its green auction mechanism On 21 August 2025, the Ukrainian Parliament adopted, as a basis, Draft Law No. 13219 "On Amendments to Certain Laws of Ukraine Regarding the Improvement of Competitive Conditions for the Production of Electricity from Alternative Energy Sources", which should significantly improve the mechanism of auctions for the allocation of Renewable Energy Sources quotas (the so-called "green auctions") and attract more foreign and domestic investors. In addition, Draft Law No.13219 amends the Guarantees of Origin regulation and facilitates the connection of new power installations to electricity grids via existing connection points.
