Further clarification on how banking contracts should be understood. A bank is not allowed to act in a way that is irrational, arbitrary or capricious but may act in their own self interests. This case will be of interest to both lenders and borrowers for the future. See: https://bit.ly/3W7vE0V #banking #lending #litigation #law #braganza

Great success for Stephen Taylor at Expert Evidence International, an IT specialist, who was providing expertise in the case of Operation Barbados. The defendant was acquitted unanimously by the jury. Daniel King of Forbes Solicitors said "His report was detailed, well-reasoned, and demonstrated a deep understanding of the technical and commercial aspects of the case." The decision of the UK Supreme Court in the Hayes and Palumbo case reverses the decisions of their original trials and two appeal court hearings. See: https://bit.ly/4lZLDta It was decided that the original direction by the judge that a financial institution could not have a commercial interest in the setting of an interest rate was wrong. This enabled the UK's highest court to exonerate the two as the juries had been mis-directed. This brings the UK financial regulation into line with other major financial centres. #LIBOR, #Crime, #Appeal, #FinancialMarkets

Interesting case where Expert Evidence provided the banking experts who were congratulated on being “measured and thoughtful”. A poor valuation was not enough for Skykomish to win the case, as the court decided that poor timing had led to the losses incurred. As a result the claim failed. Mistakes and errors can be costly, expensive, and embarrassing. This case investigates a situation where a "manifest error" resulted in a major court case and repayment of a premium amount of £3.6m plus costs. An awfully long and drawn out case involving Russian parties and with forged reports tendered as evidence to cause loss. The case explains well the Norwich Pharmacal principle which gives the Court the jurisdiction to allow a prospective claimant to obtain information in order to seek redress for an arguable wrong. An interesting case which focuses on the relationship between a client and a private bank offering investment services. Here a relationship manager mentioned (and without recommending) an investment in a fund and informed the client that the fund was not a bank's recommendation. The client sought to prove that because the relationship manager worked for the bank, used the bank's email and subsequently said that this was his favourite pick for the year ahead, so the bank was liable for any losses. In the event the fund was shown to be a massive fraud and all investment was assumed to be lost. The bank's arguments prevailed on all counts in the final judgement in the Singapore High Court. The recent case of Barclays v FCA regarding the Qatari fund raising in 2008 has established important principles regarding the provision of information to the market and potential investors. Ausaf Abbas (https://lnkd.in/dbPuyANY) of Expert Evidence is very pleased to have been engaged to provide advice on the dispute. The outcome reinforces the need to maintain ethical standards and fully disclose pertinent information to investors and the market, thereby fostering trust and stability within the financial system. As we run into the Supreme Court consideration of the criminal convictions for the manipulation of LIBOR, we see the first of the cases brought concerning the replacement of the benchmark index by an alternative. This case brings some clarity but within the confines of the particular contract used.
