BREAKING BARRIERS The Future of Pay Gap Transparency Since 2017, UK employers with 250 or more employees have been required to publish annual gender pay gap data. This regime has helped drive greater transparency and prompted many employers to revisit pay, progression, and representation in their organisations. Now, the Government is consulting on whether similar obligations should apply in relation to ethnicity and disability pay gaps, as part of a wider effort to improve workforce equality. On 14 March 2025, the Government launched a consultation on the Equality (Race and Disability) Bill, which includes proposals to introduce mandatory pay gap reporting for ethnicity and disability. REASONABLE STEPS TO PREVENT HARASSMENT Reasonable steps to prevent harassment: a lower bar than expected? While there is a lot of chatter in the employment space on the introduction of the obligation for employers to take “reasonable steps” to prevent sexual harassment last year (or even “all reasonable steps” in the case of the incoming Employment Rights Bill), it is worth recognising that this was already a test set down in law. The Equality Act 2010 includes an employer’s defence to discrimination; under this defence, where an employer can show a Tribunal that it has taken “all reasonable steps” to prevent discrimination, the employer is not liable for the acts done. Practical implications of For Woman Scotland v The Scottish Ministers This month we saw the Supreme Court (the Court) clarifying that ‘sex’ in the context of the Equality Act 2010 (the Act) refers to biological sex and not acquired gender or legal sex recognised through a Gender Recognition Certificate (GRC).
