Courts focus primarily on infringement and patent validity, with technical judges involved at every stage, and the grant of a patent serving as prima facie evidence of validity. Most PI decisions are made based on written submissions; if revoked later, the applicant may be liable for damages. With 𝗠𝗢𝗙𝗖𝗢𝗠 𝗔𝗻𝗻𝗼𝘂𝗻𝗰𝗲𝗺𝗲𝗻𝘁 𝗡𝗼. 𝟲𝟭 (𝟮𝟬𝟮𝟱), the rules now explicitly extend to 𝗳𝗼𝗿𝗲𝗶𝗴𝗻 𝗰𝗼𝗺𝗽𝗮𝗻𝗶𝗲𝘀 𝗮𝗻𝗱 𝗱𝘂𝗮𝗹-𝘂𝘀𝗲 𝗽𝗿𝗼𝗱𝘂𝗰𝘁𝘀 - a major shift for global supply chains. Key points at a glance: 1️⃣ Foreign exporters must obtain a 𝗠𝗢𝗙𝗖𝗢𝗠 𝗹𝗶𝗰𝗲𝗻𝘀𝗲 for certain materials and components (e.g. magnets). 2️⃣ 𝗘𝘅𝗽𝗼𝗿𝘁𝘀 𝘁𝗼 𝗳𝗼𝗿𝗲𝗶𝗴𝗻 𝗺𝗶𝗹𝗶𝘁𝗮𝗿𝘆 𝗲𝗻𝗱-𝘂𝘀𝗲𝗿𝘀 will not be approved. 3️⃣ Both Chinese and foreign firms must issue a “𝗖𝗼𝗺𝗽𝗹𝗶𝗮𝗻𝗰𝗲 𝗡𝗼𝘁𝗶𝗰𝗲” across the supply chain. 4️⃣ 𝗚𝗿𝗮𝗰𝗲 𝗽𝗲𝗿𝗶𝗼𝗱 until 1 December 2025. ➡️ For European 𝗱𝗲𝗳𝗲𝗻𝗰𝗲, 𝗺𝗲𝗱𝘁𝗲𝗰𝗵, 𝘀𝗲𝗺𝗶𝗰𝗼𝗻𝗱𝘂𝗰𝘁𝗼𝗿 𝗮𝗻𝗱 𝗵𝗶𝗴𝗵-𝘁𝗲𝗰𝗵 𝗰𝗼𝗺𝗽𝗮𝗻𝗶𝗲𝘀, this creates a far more complex regulatory landscape — with significant impact on 𝘀𝘂𝗽𝗽𝗹𝘆 𝗰𝗵𝗮𝗶𝗻𝘀, 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝘀 𝗮𝗻𝗱 𝗰𝗼𝗺𝗽𝗹𝗶𝗮𝗻𝗰𝗲.
