If you’re about to conduct a restructure, I recommend getting some legal advice about how you can meet your redeployment obligations. You see, a redundancy is not necessarily a ‘genuine redundancy’ just because the person’s role has been removed. There are other boxes to tick. One of those is the redeployment obligations, and the bar is higher than you may think. The High Court yesterday handed down a decision which affirmed the Fair Work Commission’s approach. That is, that the requirement to consider “all the circumstances” when assessing redeployment opportunities, is broad. Potentially including whether the employee could be placed within a role currently performed by a contractor. The High Court relied on the dictionary definition of ‘redeploy’, which is broader than “put in a vacant role”. In fact, it means “to rearrange, reorganise, or transfer” which envisages some reorganisation or rearrangement. If a business fails to meet this broad requirement as assessed in their circumstances, they won’t have the benefit of a genuine redundancy defence to any unfair dismissal claim that follows their restructure process. Russell-Cooke has announced that three of its legal assistants are starting their Qualifying Work Experience (QWE) with the firm as part of their route to qualification as solicitors. The three legal assistants are Ella Barker in the firm’s personal injury and medical negligence team, Molly Lockhart in the family team, and Oliver Ward in the corporate and commercial team. Qualifying as a solicitor through QWE is an alternative route to a traditional training contract. QWE trainees complete a period of two years of training and undertake their Solicitors Qualifying Examination (SQE). Graduate recruitment partner, Jemma Pollock, said: “we are really pleased to have Ella, Molly and Oliver starting as our first group of QWE trainees. The judgment underlines that third parties must be given the opportunity to be heard when their commercial information is at stake. The Court of Appeal has allowed an appeal by Google concerning the service of a claim form outside the jurisdiction. It has also refused a cross-appeal concerning the costs test in relief from sanctions applications. In Robertson v Google LLC [2025] EWCA Civ 1262, the claimant (a YouTuber) brought a discrimination and contract claim against Google concerning, among other things, the termination of his YouTube channel. Catrin Evans KC and Nathan Roberts represented Google, instructed by Pinsent Masons. Catrin presented Google’s case on the appeal.
