🔴 The yield war is on: despite the prohibition under the GENIUS Act & MiCA, stablecoin yield offerings are multiplying across Europe and the US👇 👉 The GENIUS Act prohibits stablecoin issuers themselves from paying interest or yield. But the Act does not explicitly extend that restriction to distribution partners such as exchanges. The result? Some players like Coinbase and PayPal have taken the lead, promising their U.S. users the ability to earn yield simply by holding stablecoins such as USDC and PYUSD. The fact that such established firms are moving ahead with these programs shows that there is clearly something at stake. Because the reality is this: there is now very little chance of amending the GENIUS Act. It is up to the regulators to act and issue their guidance. Will they allow a true regime of competition to emerge against…the banks? On August 12, several major U.S. banking groups, led by the powerful Bank Policy Institute (BPI), urged Congress to “close the stablecoin payment of interest loophole.” Last Tuesday, crypto industry groups warned that reopening the GENIUS Act would only revive old battles and hand banks an unfair advantage, arguing that banning yield programs would stifle competition and limit consumer choice. Banks are relying on the argument of deposit flight toward stablecoins, which could undermine their ability to extend credit, but also threaten the lucrative fractional reserve business model that accounts on average for 50% to 60% of their total revenues. With the GENIUS Act, the United States may have created an unprecedented competitive regime for the banking industry 👀. 🇪🇺 In Europe, the picture looks a bit different. MiCA explicitly prohibits both issuers and CASPs (entities regulated under MiCA) from offering yield. But...some players like Deblock and Bitpanda are offering it to their users. How are they doing it? By simply going through decentralized finance (DeFi) and self-custody solutions, two activities not covered under MiCA. Both firms provide access to the Morpho protocol, where users can deposit stablecoins into vaults/pools to earn yield. For Deblock, the financial structure was even validated by the French regulator. Because yes, while the GENIUS Act and MiCA set out a framework for stablecoins, legislators are still far from addressing the bigger issue: DeFi, which represents the real revolution. The debate is bound to heat up in the coming months, and we’ll be following it closely at Blockstories.
