AI in Health Care: Unlocking Potential While Navigating New Risks This week, The Guardian published a timely article on the recent JAMA Summit on AI, highlighting both transformative opportunities and critical challenges posed by artificial intelligence in health care. While AI promises to revolutionize patient care, experts are sounding the alarm on a risk that too often goes unnoticed: legal liability for medical errors involving AI. With AI systems now integral to clinical decision-making, questions of accountability are becoming increasingly complicated. If an AI contributes to an adverse patient outcome, who is responsible - the clinician, the hospital, or the developer? Existing tort law was not designed to address the opacity and intangibility of algorithms, and this legal uncertainty could ultimately stifle innovation and adoption, even as AI continues to demonstrate immense benefits for patients. Key questions for medical and legal professionals include: --How can we create clear, balanced regulatory and liability frameworks that safeguard patients while enabling the safe deployment of AI technologies? --Should indemnification clauses or new forms of product liability for software become the standard? --How can we ensure transparency in AI models - striking the right balance between proprietary protection and the need for clinical clarity? Ultimately, this is not just a legal debate - it's a matter of patient safety and the future of health care innovation. There's a practice going on called “downcoding," in which insurance companies automatically downgrade the claims a physician sends them to a lower tier of reimbursement, without actually reviewing details about the visit itself. “Some computer program is deciding what my level of care is." AMA President Dr. Bobby Mukkamala has described downcoding as a “game” to improve insurers’ finances. “It’s going to worsen our patient care, but it’s going to improve their bottom line,” Mukkamala said. “And that’s the wrong calculus to use to improve health care in this country.” Read more ⬇️
