An empirical study published by Baker Botts and the BIICL (British Institute of International and Comparative Law) has highlighted significant differences in outcomes between investor-state annulment proceedings at the ICSID and before national courts, with both success rates and the basis for successful applications varying widely. The results indicate that some national courts are annulling investor-state awards at a significantly higher rate than ICSID ad hoc committees, raising questions about finality and certainty in investor-state dispute settlement. Last week, we were delighted to host the official launch of our International Disputes team’s comparative study on annulment proceedings in ICSID and non-ICSID investor-state proceedings, published in conjunction with the BIICL (British Institute of International and Comparative Law). Johannes Koepp, Jack Biggs and Irene Zegarra-Ballón Quintanilla discussed the report’s findings, after which David Turner moderated a panel discussion featuring special guests Professor Dr. Maxi Scherer (President of the LCIA Court), Professor Martins Paparinskis (UCL) and independent arbitrator Cyrus Benson (4 New Square Chambers), followed by closing remarks from Professor Yarik Kryvoi from BIICL.
