Relief for now: #USCIS has clarified who’s affected by the new $100,000 H-1B fee — and who’s not. Most current H-1B holders and F-1 students are exempt. The fee applies only to new petitions filed on or after Sept. 21, 2025, for workers outside the U.S. Employers must pay via Pay.gov before filing, or petitions will be denied. While this guidance eases immediate concerns, it doesn’t solve the underlying instability of the H-1B system. Employers and professionals should use this time to explore more durable options like the O-1, EB-1A, and EB-2 NIW pathways.
