The “One Big Beautiful Bill Act” marks a pivotal moment in U.S. energy legislation, signaling a decisive shift back toward traditional fossil fuel development. While the Inflation Reduction Act of 2022 ushered in a new era for clean energy, the Act revises some of the IRA provisions and clears the way for renewed oil and gas production on federal lands and waters. The implications of this are broad and immediate. In a new insight, Peter Hansen and Chris Girouard highlight the 5 most important changes, including reversed royalty rates, mandated lease sales, and accelerated environmental reviews. As the U.S. and China exchange new trade measures, businesses are bracing for impact. https://lnkd.in/eNjbfaCr In a recent Law360 feature, Alexis Early weighed in on the implications of China’s expanded export controls and the potential ripple effects across global supply chains. “Companies have been put on notice,” Alexis said, highlighting the challenge of diversifying away from China, which currently produces 70% of rare earths and processes 90% of them. As we celebrate Pro Bono Week in the US, an initiative led by the American Bar Association, we are proud to reflect on the impact of giving back to the communities where we live and work. Over the years, our teams have partnered with nonprofits, legal aid organizations, and advocacy groups to deliver essential legal services to those who need them most. One powerful example of this commitment is our representation of Louisiana death row inmate Chris Duncan. Since 2016, Scott Greene and Christian Bromley, supported by Ann Ferebee, Jackson Bailey, and a wider Atlanta-based BCLP team, have worked tirelessly on Mr. Duncan’s capital post-conviction appeal. Their dedication led to a landmark ruling in April: a Louisiana state trial court vacated Mr. Duncan’s conviction and death sentence, citing compelling new evidence of his factual innocence. We invite you to join the 2025 National Celebration of Pro Bono and explore how pro bono legal advocacy can change lives. #ProBono #Advocacy #Community

In data center projects, the shell and core phase is more than a construction milestone, it’s a strategic inflection point. https://lnkd.in/eKX7Xdes At its core is the Development Management Agreement (DMA), a framework that aligns stakeholders, allocates risk, and underpins the financial viability of the entire development. A well-structured DMA does more than define responsibilities; it ensures clarity between developer and tenant obligations, mitigates interface risks among contractors, and embeds flexibility for future scalability. When paired with thoughtfully crafted lease agreements, it transforms infrastructure into stable, financeable revenue. Leases must strike a careful balance, providing tenants with operational autonomy while preserving the integrity and long-term value of the asset. This includes governing fit-outs, enabling phased expansion, and ensuring compliance with evolving regulatory and ESG standards. As the industry continues to evolve, the ability to integrate technical delivery with commercial foresight is becoming increasingly critical. For those navigating the complexities of shell and core development or lease structuring, exchanging perspectives and best practices is more important than ever. Our cross-disciplinary team of real estate, construction, finance, and regulatory lawyers understands the intricate dynamics of data center development. We provide the commercially grounded legal advice needed to structure resilient, scalable, and future-ready digital infrastructure. #DataCenters #CommercialRealEstate #LeaseStrategy

Significant changes may be on the horizon for US patent law. https://lnkd.in/ev-8KTRn The United States Patent and Trademark Office has proposed new rules that would curtail the ability to challenge issued patents before the Patent Trial and Appeal Board. Partner Scott W. Cummings recently authored an alert, taking a deep dive into the proposed changes, noting that clients may need to adjust to these proposed changes in the near future, and develop new strategies in future patent litigation and freedom to operate matters. The PTAB looks at the validity of some of the most valuable patents involved in litigation through a highly specialized review process created in 2012. #PatentLaw #Trademarks

By 2028, large companies in France (and other EU Countries) that meet CSRD criteria will be required to publish detailed sustainability reports on the 2027 fiscal year. https://lnkd.in/eWe4EYng Under Articles 19a and 29a of the CSRD, large companies must collect ESG data from their suppliers, including small and medium-sized enterprises, to meet double materiality and transparency obligations. This reporting places the entire value chain under increased scrutiny. Small and medium-sized enterprises (SMEs) are facing mounting pressure. Yet many SMEs lack the resources, systems, and capacity to report effectively. What should Phase 2 companies start to do in anticipation of future legislation that will limit even more what they can request from their SME suppliers? - Align supplier policies with proportionality principles - Limit ESG data requests to the VSME voluntary standard - Prepare for contractual updates reflecting new sustainability obligations Read our full briefing, by Partner and ESG Lead Roland Montfort to understand what’s changing and how to prepare. #Sustainability #ESG #SupplyChain
