The Equal Credit Opportunity Act (ECOA) prohibits lenders from discriminating in extending credit to any applicant on the basis of race, color, religion, national origin, sex, marital status or age. Discrimination under the ECOA can include not only the decision to extend credit, but also the terms under which credit is extended, such as interest rates and the taking of collateral and guaranties. On August 7, 2025, President Trump signed the “Guaranteeing Fair Banking For All Americans” Executive Order, with the stated goal of ending “debanking on the basis of … political affiliations [and] religious beliefs….” In light of this order, lenders and creditors should anticipate heightened regulatory requirements and scrutiny, and are advised to document reasons for extending, or not extending, credit. Lathrop GPM successfully represented Munchkin, Inc., in a patent infringement lawsuit against TOMY International. On September 12, 2025, after a five-day trial, a jury in the U.S. District Court for the Northern District of Illinois delivered a verdict in favor of Munchkin on all its claims, finding that TOMY infringed Munchkin’s design patent protecting its popular Miracle® 360° Sippy Cup. The verdict follows a prior finding by the court that TOMY also infringed a Munchkin utility patent protecting the same cup. The jury also determined TOMY’s infringement of both patents was willful, and awarded Munchkin more than $3.9 million in damages as a result. On January 1, 2026, the Centers for Medicare and Medicaid Services will deploy WISeR, a new enforcement initiative that relies on artificial intelligence to scrutinize Medicare claims. The Wasteful and Inappropriate Service Reduction (WISeR) Model is the product of the agency’s efforts to leverage next-generation technology in its decades old effort to tackle health care fraud and abuse. Citing statistics indicating Medicare spent as much as $5.8 billion in 2022 on “unnecessary” services, the Center for Medicare and Medicaid Innovation has obtained the assistance of private companies with expertise using AI and machine learning to manage the prior authorization process – which will inevitably lead to heightened scrutiny of claims for specified services.
