Flexibility drives resilience. Regulation should enable, not restrain. Progress depends on permission to adapt. In the seventh article of our “Breathing Life Back Into Subprime Offices” series, the McGuireWoods LLP London #realestate team explores how modernising permitted development rights could unlock faster, lower-cost transitions between compatible commercial uses – such as office to education. As Danielle St Pierre MRTPI, Hybrid Planning & Development, noted: “Changes to the Use Classes Order in 2020 have provided much greater flexibility in respect of existing commercial premises. This enables buildings previously used for light industrial, retail or even medical facilities to be converted to office use, which previously required full planning permission. This is a step in the right direction, however, there are still a number of restrictions, including conditions attached to previous planning permissions, which prevent such changes of use and cause unnecessary delays.” Too many viable buildings are stuck in limbo due to rigid planning classifications. As Harry Neal, St Anselm, put it: “An increased ability to flip between different uses and not require planning permission would be super helpful – particularly for educational use, which is not too dissimilar to office use.” By streamlining low-impact changes of use, we can reduce legal and admin costs, speed up project delivery, and help preserve vital employment infrastructure. In late September, the Financial Crimes Enforcement Network posted a notice to the Federal Register soliciting comments on a proposed “Survey of the Costs of Anti-Money Laundering and Countering the Financing of Terrorism Compliance” to be completed by nonbank financial institutions. On Oct. 9, #FinCEN published FAQs clarifying the requirements around filing suspicious activity reports.
