Today is National Whistleblower Day. It's a day for us to celebrate those who took massive risks to expose wrongdoing. It’s also a chance for us to reflect on how far we’ve come—and what’s next. When I first started practicing, whistleblower law was barely taught in law schools. Today, lawyers, friends, and strangers on the street know what I'm talking about when I say, "I represent whistleblowers." We have robust regulatory frameworks and better legal protections for those who experience retaliation. To most humans, whistleblowers are not seen as “squeaky wheels,” but people who care about doing what’s right. We still have a lot of work to do. But the whistleblower law community, united in our common goal of stopping fraud, makes me proud to be doing this work every day. Happy National Whistleblower Day (July 30)! Here's Dave Jochnowitz on why it's so important to celebrate whistleblowers. This month also marks the 15th anniversary of the Dodd-Frank Wall Street Reform and Consumer Protection Act, a sweeping legislative package passed in response to the global financial crisis. Among its many achievements, Dodd-Frank created the SEC Whistleblower Program. This program has returned billions of dollars to harmed investors. It empowers people to report securities violations to government regulators by offering whistleblowers significant financial incentives and legal protections. Happy to share that our longstanding Title VII disparate impact case against NTT challenging the company's criminal history screen can finally proceed to discovery! This case was filed in 2018, has been up to the Second Circuit twice, and I'm now looking forward to moving past the pleading stage and litigating it with our colleagues at Outten & Golden LLP (Ossai Miazad, Adam Koshkin) and LDF (Rachel Kleinman, Tiffani Burgess)!

The modern workplace is more diverse and dynamic than ever. Yet discrimination persists—from pay inequality to advancement barriers. AI systems risk amplifying these inequalities, while increasing attacks on workplace equity initiatives sow confusion. This creates new and evolving challenges for both employees and managers. As lawyers, we don’t just have a professional responsibility to keep up with these changes—we must also be models of civility and collaboration, even in times of disagreement. We're proud to be partnering with Public Interest Law Center on this important disparate impact discrimination case. In April 2024, the EEOC sued convenience store chain Sheetz alleging its criminal background check policies discriminated against Black, American Indian/Alaska Native, and multiracial candidates. But last month, the EEOC notified affected job applicants it was dropping the case—not based on the evidence, but due to a directive from President Trump. We have since moved to intervene to ensure their voices are heard. “Our client is doing what the law allows—and demands—when government enforcement falls short: workers are stepping in to carry the case forward," said Jenny Yang.
