From 10 June 2025, major reforms in the Family Law Amendment Act 2024 will commence. These changes will impact all family law professionals, including Family Dispute Resolution Practitioners and lawyers that assist separating couples. The reforms will affect how financial and property matters are handled in separations. They ensure the economic impact of family violence is considered in property settlements, where relevant. They also affect other areas of family law, including case management of divorces, family dispute resolution, and how the court can protect sensitive information. Over 80% of FCFCOA (Federal Circuit and Family Court) cases involve major risk factors like family violence. Last week, the Australian Government released a report on making the Family Law system safer and fairer for those needing Family Violence Protection Orders. The report made 11 recommendations, highlighting that women leaving abusive relationships often navigate both state and federal courts, adding stress to an already complex time. Domestic violence orders are designed to protect victims from violence, while federal law requires the family court to prioritise the child’s best interests. The Australian Parliament has passed the Family Law Amendment Bill 2024 today. The Bill makes important and significant reforms to Australia’s family law system with a focus on property and financial matters. The Bill was amended in Parliament to address particular recommendations of the Senate Legal and Constitutional Affairs Legislation Committee and feedback from stakeholders. This includes changes to provisions relating to companion animals, the less adversarial approach, disclosure, divorce, protected confidences, and costs orders. After the Bill receives Royal Assent, there will be a six-month lead in time before most of the changes come into effect. This will allow time to implement and communicate these important changes to the family law sector and broader community. Some changes will commence immediately after Royal Assent, including changes to Commonwealth Information Orders. Powerful, insightful, unforgettable – just some of the words to describe Matt and Sarah’s amazing presentation and passionate advocacy for creating change and healthy masculinity role modelling. Matt and Sarah’s work has had an enormous impact in New Zealand and globally however their key message is simple - breaking the cycle of intergenerational trauma starts with one step.  “Your childhood trauma is not your fault, but your healing is your responsibility”.
