If you work in compliance or data privacy, pay attention. California just passed SB 53, and it’s being called CCPA for AI. This is the first law in the US that regulates foundation models at the compute layer, not just downstream uses. It applies to large AI developers training frontier models and introduces mandatory governance, risk reporting, whistleblower protections, and incident disclosure. If CCPA forced companies to get serious about privacy, this law does the same for AI transparency and accountability. Are we one bad use case away from setting legal AI adoption back years? If so, it won’t be because of hallucinations. It’ll be a more potent blow to client trust. A data breach. 👾 One public spectacle of a firm mishandling client data and the entire industry takes notice. Because bad actors are also innovating outside the constraints of law and ethics. We’ve already had glimpses of what that could look like. Last year, Orrick, Herrington & Sutcliffe reached an $8 million settlement over a 2023 cyberattack compromised the personal data of roughly 600,000 individuals. The exposed information was limited (names, contact details, dates of birth). But imagine if the breach had gone one layer deeper… In law, it’s not just personal information at risk. It’s privileged communications, litigation strategy, and trade secrets—the most sensitive data any client entrusts to a firm. If that confidence is breached, the damage is nearly impossible to quantify. Every major shift in legal technology has faced a moment where the confidence between client and counsel is tested. Once it breaks, fear can outweigh innovation for years. That was one of the issues I unpacked in my recent discussion with Rok Popov Ledinski, who’s leading some exciting work in The Netherlands and abroad at the intersection of AI, governance, and innovation.
