The Thomson Reuters v. ROSS Intelligence interlocutory appeal, pending in the Third Circuit, is one of the first appellate proceedings about fair use and artificial intelligence. KBL attorneys Michael Kwun and Elizabeth Dinh today filed a brief amici curiae on behalf of the Computer & Communications Industry Association, Chamber of Progress, and NetChoice urging the Third Circuit to take care in faithfully applying the law of fair use.

Unregulated speech is the single greatest threat to a free society. Our refusal to set boundaries protects the machinery of liberty's destruction, allowing our public discourse to fracture completely. Deliberate, high-impact misinformation campaigns are a core feature of the system, monetized and weaponized to erode our shared reality. The common rebuttal, "Who decides?", is a distraction from the urgent, practical solution. We already have functional models for regulating complex systems. The legal system, financial markets, and public health all rely on independent bodies to adjudicate facts and enforce standards. The challenge is to architect resilience against coordinated, systemic deceit.
