Has AI enforcement risk materialized in the U.S.? Yes. As Orrick data partner Nicholas Farnsworth noted at IAPP’s recent AI Governance conference: The flurry of state law enactment and recent enforcement activity “raises the bar everywhere.” Nick led a discussion with state AG representatives Jared Rinehimer and Tyler Bridegan exploring how they’re navigating the emerging patchwork of over 160 AI-specific state laws – and how state cooperation is increasing. Are we one bad use case away from setting legal AI adoption back years? If so, it won’t be because of hallucinations. It’ll be a more potent blow to client trust. A data breach. 👾 One public spectacle of a firm mishandling client data and the entire industry takes notice. Because bad actors are also innovating outside the constraints of law and ethics. We’ve already had glimpses of what that could look like. Last year, Orrick, Herrington & Sutcliffe reached an $8 million settlement over a 2023 cyberattack compromised the personal data of roughly 600,000 individuals. The exposed information was limited (names, contact details, dates of birth). But imagine if the breach had gone one layer deeper… In law, it’s not just personal information at risk. It’s privileged communications, litigation strategy, and trade secrets—the most sensitive data any client entrusts to a firm. If that confidence is breached, the damage is nearly impossible to quantify. Every major shift in legal technology has faced a moment where the confidence between client and counsel is tested. Once it breaks, fear can outweigh innovation for years. That was one of the issues I unpacked in my recent discussion with Rok Popov Ledinski, who’s leading some exciting work in The Netherlands and abroad at the intersection of AI, governance, and innovation. We explored how legal systems are adapting (and in some cases, not yet ready) for the rapid pace of AI adoption. 🔗Full discussion linked in the comments below. #LegalAI #AIGovernance #DataPrivacy #Trust #LegalInnovation #TheRecurialCodex #AIethics #LegalTech

If you work in compliance or data privacy, pay attention. California just passed SB 53, and it’s being called CCPA for AI. This is the first law in the US that regulates foundation models at the compute layer, not just downstream uses. It applies to large AI developers training frontier models and introduces mandatory governance, risk reporting, whistleblower protections, and incident disclosure. If CCPA forced companies to get serious about privacy, this law does the same for AI transparency and accountability. I wrote a full breakdown of what SB 53 actually says, who it covers, and how companies can get ahead of it now. If your work touches AI governance, privacy compliance, or emerging tech policy, it’s worth a read. 🧠 Full blog post: https://lnkd.in/eTzNG3Vd #AIgovernance #DataPrivacy #CCPA #SB53 #ResponsibleAI #FrontierModels #TechPolicy #StillwaterInsights

In my October State Bar of Texas TBJ piece, I dug into how AI governance is splitting down two different paths: 🇪🇺 Europe: one centralized, risk-based framework (the EU AI Act): strict deadlines, clear rules. 🇺🇸 U.S.: a growing patchwork. States like Texas, California, and Utah are each testing their own mix of AI, privacy, and consumer protection laws while federal action stalls. This IAPP article takes a different angle (https://lnkd.in/gdbnhNe7) state enforcers are going after specific AI risks instead of pushing for broad, unified rules. It’s practical for the moment, but it also means companies are left managing a patchwork of obligations that keeps shifting state by state (good luck with that!) IMO, The smart move now is to adapt... and fast, align with global frameworks, high industry standards, stay alert to state shifts, and build flexibility into your governance playbook. #AIRegulation #AIGovernance #ResponsibleAI #LegalTech #DataPrivacy #ATX #TBJ
