Washington has confirmed that the new port fees on Chinese-linked ships will take effect on October 14, ending speculation of a delay. The US Customs and Border Protection detailed how the fees will be enforced, targeting vessels owned, operated, or built in China. Under the new rule, Chinese-owned ships will pay $50 per net ton, while foreign operators using Chinese-built vessels will pay the greater of $18 per net ton or $120 per container. The move is part of Washington’s effort to counter Beijing’s “state-backed dominance” in global shipping. Beijing responded swiftly by revising its maritime transport regulations, creating a legal framework for countermeasures—including reciprocal port fees, ship entry restrictions, and limits on data access for foreign entities. Yesterday, US Customs & Border Protection (CBP), US Citizenship & Immigration Services (USCIS), and the US Department of State (DoS) confirmed that the new $100k H-1B fee applies to new applications filed on or after 21 Sep 2025. Existing approved petitions and valid visas appear to be unaffected removing some uncertainty for current H-1B holders travelling to the USA. USCIS and U.S. Customs and Border Protection have clarified that President Trump’s recent proclamation restricting H-1B entries applies only to petitions filed on or after September 21, 2025. This means foreign nationals with pending or approved H-1B petitions or valid H-1B visas should not be subject to the new restrictions and should be able to enter the United States after the effective date. The new $100,000 fee will apply only to H-1B petitions filed for individuals outside the United States on or after September 21. Travelers may still experience delays at ports of entry as agencies implement the policy. Additional guidance from the Department of State and on the new fee requirement is expected.
