Vertex was retained by counsel for the joint venture that constructed a 3000 foot breakwater and other harbor improvements in Chicago, IL as delay termination, damages and forensic accounting experts. Vertex had two named experts in the matter who collectively evaluated the performance and termination of a joint venture partner and the reasonableness and quantum of damages to complete the work and settle. Payment claims Vertex prepared 6 expert reports on the matter, which included review of delay issues, payment reconciliation, evaluation of reasonableness of termination and completion, cost mitigations, review of defective work, cost estimating funds, tracing, and computation of damages under various legal theories and interest models. Vertex also analyzed the terminated members expert analysis related to a separate litigation to determine if the cost claimed in that. Matter where actually incurred and paid. Vertex provided deposition testimony in the matter, and the case ultimately settled pretrial.
