Stock exchange operator Nasdaq will no longer seek to compel companies to report the diversity of their boards, following a ruling this week by the Fifth Circuit that found the Securities and Exchange Commission exceeded its legislative authority in approving the disclosure rules. The court reversed a three-judge panel ruling from last year allowing the diversity plan to proceed, and Nasdaq says it will not pursue the matter further.
