Major and controversial topics in criminology are ex-
amined by one of Europe’s most distinguished jurists
in this collection of six essays, three of which have
never been published before.
In the two introductory Chapters, Professor Ross
discusses the legal concepts of guilt and responsibility
and compares these with their moral and philosophical
counterparts. He goes on, in Chapters 3 and 4, to
examine the justifications for punishment and argues
that retribution cannot by itself be an aim of punish-
ment. In the last Chapters he challenges the opinion
that determinism as an explanation of criminal behavior
is necessarily inconsistent with morality, and he
demonstrates that the statement that a man could not
have acted otherwise cannot logically be extended to
invalidate moral statements about his behavior.
The scope for philosophical analysis in criminology is
not so restricted as has been thought, and Professor Ross
brings to his subject the clarity of style and wide range
of learning that characterized his earlier works in
jurisprudence and which gave to Qn Law and Justice
and Directives and Norms the classic status they have
maintained to this day. This important and provocative
study will be essential reading for all students of
