Plaintiff, by counsel, respectfully states: 1. The Initial presentation of the defense evidence is on

handling this case, cannot attend the hearing on said date as he would be on official leave from the plaintiff Bank. 3. In addition, the other lawyers are not available to attend the

hearing on the said date as they have already their own previously scheduled engagements. Thus, the undersigned counsel is constrained to move the cancellation of the said hearing, and resetting of the same on ______________ or on any date as the calendar of the Court may allow. 4. The undersigned counsel respectfully begs the indulgence

and understanding of the Honorable Court, and humbly apologizes for the possible inconvenience that he may cause by the cancellation of the said hearing. 5. This motion is not intended to delay the proceedings in this case but is necessitated solely by the foregoing reasons. 1

Service By Post

Copies of this Motion cannot be personally served upon the opposing counsel and filed before the Honorable Court because of momentary absence of available personnel to personally serve the same. Upon the other hand, counsel has other equally important matters to attend to which prevents him from personally serving the motion.

WHEREFORE, plaintiff respectfully prays that the hearing on _______________ be cancelled and reset to ______________ or any date as the calendar of the Honorable Court may allow.
