THE ARCHITECTS RESPONSIBILITIES IN RELATION TO THE PEOPLE 1. STATEMENT: The Architect is engaged in a profession which carries with it civic responsibilities towards the public, whether such responsibilities are the natural outcome of good citi enship or of his professional pursuit or whether the! parta"e of informative and educational matters or of his normal, good public relations. 1#a The Architect shall see" opportunities to be of co$nstructive service in civic and urban affairs and to the best of his abilit! advance the safet!, health and well#being of the people and the communit! as well as the promotion, restoration or preservation of the general amenities and other e%amples of historic and architectural heritage of the nation. The Architect shall promote the interest of his professional organi ation and do his full part of the wor" to enhance the ob&ectives and services of the organi ation. 'e should share in the interchange of technical information and e%perience with the other design professions and the building industr!. The Architect as a good citi en shall abide and observe the laws and regulations of the government and compl! with the standards of ethical conduct and practice of the profession in the (hilippines. 'e shall at no time act in a manner detrimental to the best interest of the profession. The Architect shall not use paid advertisement nor use self#laudator!, e%aggerated or misleading publicit!. 'owever, the presentation of factual materials, verbal or visual, of the aims, standards and progress of the profession through literature or b! industrious application of his wor" and services which tend to dignif! the professional or advance public "nowledge of the Architect)s function in societ! ma! be presented through an! public communication media. The Architect shall not solicit nor permit to solicit in his name, advertisements or other support towards the cost of an! publication presenting his wor". 'e should refrain from ta"ing part in paid advertisement endorsing an! materials of construction or building e*uipment. The Architect shall not mislead the public through advertisements, signs or printed matter citing his professional speciali ations unless such *ualifications are well "nown facts or sanctioned b! professional consensus and !ears of e%perience. THE ARCHITECTS RESPONSIBILITIES IN RELATION TO HIS CLIENT +. STATEMENT: The Architect)s relation to his ,lient is depended upon good faith. To insure the continued e%istence of such state of good relationship, the Architect)s position carries with it certain moral obligations to his ,lient and to himself. +#a The Architect ma! introduce to a prospective ,lient the professional services he is able to perform provided it is limited to presentation of e%amples of his professional e%perience and does not entail the offering of free preliminar! s"etches or other services without the benefit of an agreement with the ,lient for legitimate compensation.

The Architect shall ac*uaint or ascertain from the ,lient at the ver! inception of their business relationship, the e%act nature and scope of his services and the corresponding professional charges. The Architect shall advise a ,lient against proceeding with an! pro&ect whose practicabilit! ma! be *uestionable due to financial, legal or arresting or e%igent conditions, even if such advice ma! mean the loss of a prospective commission to the Architect. The Architect shall e%plain the conditional character of estimates other than estimates submitted in the form of actual proposals b! contractors and in no case shall be guarantee an! estimates or cost of the wor". Neither shall he mislead his ,lient as to probable cost of the wor" in order to secure a commission. The Architect shall consider the needs and stipulation of his ,lient and the effects of his wor" upon the life and well#being of the public and the communit! as a whole, and to endeavor to meet the aesthetic and functional re*uirements of the pro&ect commensurate with the ,lient)s appropriation. The Architect shall charge his ,lient for services rendered, a professional fee commensurate with the wor" involved and with his professional standing and e%perience based upon the -asic Minimum .ee prescribed under the /Standards of (rofessional (ractice0 of the /Architect)s National ,ode0. The Architect shall not underta"e, under a fi%ed contract sum agreement, the construction of an! pro&ect based on plans prepared b! him. 'e ma! in certain cases, underta"e the construction of a pro&ect even when the plans were prepared b! him provided it is underta"en in conformit! with the conditions set forth under sections covering /,onstruction Services0 /,omprehensive Services0 or /1esign# -uild Services0 of the document on /STAN1A21S 3. (23.ESS43NA5 (2A,T4,E.0 The Architect shall be compensated for his services solel! through his professional fee charged directl! to the ,lient. 'e shall not accept nor as" for an! other returns in whatever form from an! interested source other than the ,lient. The Architect shall be free in his investments and business relations outside of his profession from an! financial or personal interests which tend to wea"en and discredit his standing as an unpre&udiced and honest adviser, free to act in his ,lient)s best interests. 4f the Architect has an! business interest which will relate to, or affect the interest of his ,lient, he should inform his ,lient of such condition or situation. 6. STATEMENT: The ,ontractor depends upon the Architect to safeguard fairl! his interests as well as those of the ,lient. 6#a The Architect shall give the ,ontractor ever! reasonable aid to enable him to full! understand the contents of the ,ontract 1ocuments b! furnishing clear, definite and consistent information in all pertinent contract documents to avoid unnecessar! mista"es that ma! involve e%tra costs to the ,ontractor.

The Architect shall not "nowingl! call upon the ,ontractor to correct or remed! oversights or errors in the ,ontract 1ocuments to the ,ontractor)s financial disadvantage. The Architect shall immediatel! upon his personal "nowledge and inspection, re&ect or condemn materials, e*uipment or wor"manship which are not in conformit! with the ,ontract 1ocuments in order not to cause unnecessar! dela! and additional e%pense to the ,ontractor. The Architect shall not, at an! time or circumstance, accept free engineering services, or receive an! substantial aid, gifts, commissions, or favors from an! ,ontractor or subcontractor which will tend to place him under an! "ind of moral obligation. The Architect shall, upon re*uest b! the ,ontractor, promptl! inspect each phase of the wor" completed and if found according to the terms of the ,ontract 1ocuments issue the corresponding ,ertificates of (a!ment and the .inal ,ertificate of ,ompletion, respectivel!, to the ,ontractor. 7. STATEMENT: An e%change of technical information between Architects and those who suppl! and handle building materials or e*uipment is necessar! and therefore encouraged and commended. 'owever8 7#a The Architect shall not avail or ma"e use of engineering or other technical services offered b! manufacturers, or suppliers of building materials or e*uipment which ma! be accompanied b! an obligation detrimental to the best interest of the ,lient or which ma! adversel! affect the Architect)s professional opinion. The Architect shall not at an! time receive commissions, discounts, fees, gifts or favors from agents or firms handling building materials or e*uipment which ma! place him in a reciprocal frame of mind. 'e ma! however, accept mar"et discounts which shall be credited to the ,lient.

THE ARCHITECTS RESPONSIBILITIES IN RELATION TO HIS COLLEAGUES AND SUBORDINATES 9. STATEMENT: The Architect has moral responsibilities towards his profession, his colleagues and his subordinates. 9#a The Architect shall not render professional services, without compensation e%cept for small civic or charit! pro&ect. 'e shall neither offer nor provide preliminar! services on a conditional basis prior to definite agreement with the ,lient for the commission of the pro&ect. The Architect shall not "nowingl! compete with other Architects on the basis of differences of professional charges, nor use donation as a device for obtaining competitive advantage e%cept for worth! civic or religious pro&ects. submit solicited or unsolicited s"etches or drawings in competition with other Architects unless such competitive arrangements are conducted substantiall! under the terms of the :A( Architectural ,ompetition ,ode 9#c The Architect shall not under an! circumstances nor through an! means see" commissions alread! "nown to him as previousl! endowed to another Architect, whether such endowment has been definitel! agreed upon or still in the process of negotiation. The Architect shall not, in an! case, enter as a competitor in an! Architectural ,ompetition when he has direct relations with the formulation of the (rogram thereof or when he has been engaged to act as (rofessional Adviser or ;uror for such competition. Neither shall the Architect accept and act as professional adviser or &uror in an! architectural competition when he has had an! information or has reviewed or assisted in the preparation of an! competition design entered. Nor shall an Architect, retained as professional adviser in a competition, accept emplo!ment as an Architect, retained as professional adviser in a competition, accept emplo!ment as an Architect for that competition pro&ect e%cept as ,onsulting Architect. The Architect shall not underta"e a commission for which he "nows another Architect has been previousl! emplo!ed until he has notified such other Architect of the fact in writing and has conclusivel! determined that the original emplo!ment has been terminated and has been dul! compensated for. The Architect shall not underta"e a commission for additions, rehabilitation or remodeling of an! erected structure underta"en previousl! b! another Architect without dul! notif!ing him of the contemplated pro&ect even when the 3wner is no longer the same. <hen the greater mass, area or design of the original structure is substantiall! maintained the new Architect should limit his advertisement or claim onl! to the e%tent of the wor" done to the structure. Architects are en&oined to preserve or restore as much as possible especiall! the few and remaining historic e%amples of our architectural heritage affecting his phase of practice. The Architect shall not "nowingl! in&ure falsel! or maliciousl!, the professional reputation, prospects or practice of another Architect. The Architect shall refrain from associating himself with or allowing the use of his name b! an! enterprise of doubtful character or integrit!. The Architect shall not affi% his signature and seal to an! plans or professional documents prepared b! other persons or entities not done under his direct personal supervision. The Architect shall inspire the lo!alt! of his emplo!ees and subordinates b! providing them with suitable wor"ing conditions, re*uiring them to render competent and efficient services and pa!ing them ade*uate and &ust compensation therefore. 'e shall tutor and mentor the !oung aspirants towards the ideals, functions, duties and responsibilities of the profession. The Architect shall unselfishl! give his share in the interchange of technical information and e%perience among his colleagues and !oung aspirants and do his part in fostering unit! in the fellowship of the profession.

A6#$7, Series of 1AA6, all of which provide for the adoption of a s!llabus for ever! sub&ect in the licensure e%aminations8 <'E2EAS ever! adopted s!llabus, which contains the various concepts, principles, and application thereof, shall be the basis for the e%amination *uestions that will be inputted into the test *uestion ban"8 <'E2EAS after consultation with the various schools of architecture in the (hilippines, the 1epartment of Education, ,ulture and Sports >1E,S?, and the :nited Architects of the (hilippines >:A(?, the -oard of Architecture formulated a set of s!llabi for the various e%amination sub&ects in architecture8 <'E2EAS the -oard of Architecture consulted the ,ouncil of 1eans and the 'eads of Architectural Schools of the (hilippines and the :nited Architects of the (hilippines for the final adoption of the s!llabi.
