COMES NOW, Plaintiff, Derek Kimball Hairston, and hereby and herein states: 1. Upon considerable and serious consideration of the matter, Plaintiff hereby and herein withdraws his Complaint and gives notice thereof to this Honorable Court and all parties (Defendants) therein as identified in the caption. 2. Plaintiff is no longer certain as to any of the facts he has set-fourth within said Complaint and subsequent pleadings upon reflection and consideration of argument and defense put forth by Defendants in response thereto. 3. As a result Plaintiff not wishing or desiring to cause anyone undue stress, time and expense in a matter in which this Plaintiff is no longer certain of as to the justice of Plaintiffs cause, Plaintiff withdraws said Complaint and any further action therein.
