About 6:30 in the evening of January 2, 2015, Manalo S. Matalo decided to go
home. Then, Manalo S. Matalo passed by the house of Juan Dela Muerto were Manalo
S. Matalo saw Juan and Pedro having an argument at the porch on the second floor.
Then, Manalo S. Matalo stop walking for about 2 minutes, he looked at them because
it was not normal for two people having drinking spree carrying bolos, Manalo S.
Matalo noticed that the accused was also carrying a .45 which is normally located at
his right waist considering that he is a security guard, then Manalo S. Matalo
continued walking and did not bother Juan and Pedro thinking that they were already
drunk. For about 5 seconds after passing the house of Juan dela Muerto, Manalo S.
Matalo heard a gunshot coming from the second floor porch house of Juan and
immediately ran away and reported it to nearest police station.
