Activity No. 1 1. Would You Crush A Close Friend To Win A Lawsuit?

An ethical lawyer must prioritize justice over personal relationships. While relationships and profession should remain separate, a lawyer's primary duty is to safeguard their client's rights and interests, even if it means opposing a close friend. The lawyer-client relationship develops from a social obligation for lawyers to provide legal aid to those in need. No person can be deprived of life and liberty without due process, so all are entitled to counsel regardless of financial means. To be ethical, a lawyer must conduct themselves with good moral character, integrity, dignity, and respect toward colleagues. They must uphold the constitution, obey laws, and promote respect for legal processes.

1. Would you crush a close friend to win a lawsuit?

Yes. The primary duty of a lawyer is to see that justice is done. Under
the Code of Professional Responsibility, a lawyer shall make his legal services
available in an efficient and conventional manner compatible with the
independence, integrity and effectiveness of the profession. Hence, a lawyer
shall not reject a case, except for valid reasons, and render legal advice
and/or accept and win the case, even if it takes crushing over a close friend.
Relationship and profession are two worlds apart and I believe that what is
important is that you are doing all that is necessary to safeguard the rights
and interest of your clients.

2. In a nutshell, what is the nature of the relationship of a lawyer

and client?

To practice law is a special privilege. Such privilege is not however without

any burden. One of the burdens of a lawyer is the social obligation which
requires one to render legal aid to the needy. The nature of the relationship
of a lawyer and client is that a person cannot be deprived of his life and
liberty without due process of law, therefore, a person, no matter how
financially destitute, is entitled to be heard through counsel and it is when
the lawyer-client relationship develops.

3. What does it take to be an ethical lawyer?

An ethical lawyer always conducts himself/herself in his/her professional
life with good moral character and without deception. Also, an ethical lawyer,
at all times, maintain integrity and dignity of the legal profession, conduct
himself/herself with courtesy, fairness and candor toward his/her professional
colleagues. Moreover, an ethical lawyer upholds the Constitution, obeys the
laws of the land and promotes respect for the law and legal processes.
