Felicito G. Inding witnessed Arnold A. Chavez shoot Ernesto O. Guerrero at his convenience store. [1] Inding was working as a store helper when he saw Chavez, a regular customer, become angry after being refused a loan. [2] On the day of the shooting, Chavez asked for cigarettes then pulled out a gun and shot Guerrero without warning. [3] Inding hit Chavez with a knife to make him stop, and Chavez fled on a motorcycle. [4] Inding provided this affidavit to support filing criminal charges against Chavez for the shooting.

AFFIDAVIT OF WITNESS

I, FELICITO G. INDING, 35 years old, single, and a resident of


Block 3, Lot 1, Ramos Village, Sta. Filomena, Dipolog City, after
having been duly sworn to in accordance with law, hereby depose
and say THAT:

1. I personally saw the accused, Arnold A. Chavez, commit the


crime as alleged against Ernesto O. Guerrero;

2. I am a hired help of Ernesto O. Guerrero, whom I fondly call


Manong Ernesto; tasked to assist him in the multi-purpose
convenience store located at Stall 3, Majika Commercial
Complex, Sta. Filomena, Dipolog City during business hours;

3. On the afternoon of January 13, 2017, I was restocking the


display shelves of the goods delivered earlier that day when
two customers on a motorcycle stopped right in front of the
store;

4. I continued restocking the front display shelves so, the


owners son, Sebastian O. Guerrero, assisted the customers
instead. One of the customers was Arnold A. Chavez, our
neighbors hired laborer. He is a frequent customer of the
store because its the store nearest to their workplace so he
and his co-workers would usually have their merienda and
drinking session after work there;

5. After he was given the pack of cigarette he asked for, I saw


Arnold Chavez jostle inside his bag as if desperately looking
for something. To my surprise he took out a gun and shot
Manong Ernesto;

6. I ran towards Arnold Chavez as he was aiming his gun at
Sebastian so I got the knife I was using to open the boxes
of goods and hit Arnold Chavez on his arm with it. He ran to
the motorcycle which sped off;

7. Earlier that week, Arnold Chavez requested me to ask


Manong Ernesto if he could borrow money. Manong Ernesto
refused since he still has an outstanding debt for store
goods unpaid for over 2 months and he is already known to
be Palainom and Sugarol.

8. When I told him Manong Ernesto cannot lend him money,


he got very angry and said Magmahay ra jud nang
tigulanga na! Dalo kaayo! then left. I did not see him after
our conversation until the day of shooting;

9. I executed this affidavit to attest the truthfulness of the


foregoing facts and to support the filing of the criminal case
against Arnold Chavez.

IN WITNESS WHEREOF, I have hereunto set my hand this


16th day of January 19, 2017 at Dipolog City, Philippines.
