AFFIDAVIT OF DRIVER

I, ERNESTO A. GALINDO, Filipino, of legal age, and a resident of Miranda, Damilag,


Manolo Fortich, Bukidnon, Philippines, after being sworn in accordance with law, hereby
depose and say that:

1. I am the driver of the Prime Mover (Truck Tractor) with plate no. GGX-563 and
Trailer with plate no. KZA-129 both registered under the name of AAG Trucking;

2. On May 20, 2006 at around 1:20 oclock in the afternoon, I was driving the
aforementioned prime mover truck with trailer somewhere in Dalirig, Bukidnon heading
to Cagayan de Oro City. Since there was a slow moving 6-wheel Forwarder in-front of
my driven prime-mover truck, I overtook the said 6-wheel Forwarder. After I was able to
overtake the Forwarder and when I was already driving on my proper lane, I noticed a
Toyota Hilux coming from the opposite side and which was running at a very fast speed;

3. Since it was raining during that time, the said Toyota Hilux then suddenly
swerved to its left and hit the left-side of my driven Prime Mover including the portion
where the fuel tank was located;

4. In consequence of the preceding incident, several portions of the Prime Mover


truck were damaged including the stepboard, steering box, front spring and the bracket
of the fuel tank;

5. I execute this affidavit to attest to the truth of the foregoing facts and for any
other legal intents and purposes which this may serve.

IN WITNESS WHEREOF, I have hereunto affixed my signature this ___ day of May
