RESOLUTION

Plaintiff posted its "MANIFESTATION AND COMPLIANCE" on


March 5, 2014 to the Court's Resolution dated February 24, 2014 ordering
plaintiff to submit the originals or the certified true copies of the following
documents: (1) the Letter addressed to City Prosecutor Hilda Fantastico-
Ibuyan, dated July 22, 2013, SUBJECT: Filing of Criminal Charge against
MS. JANET C. LEY of 1229 Apolonia St., Mapulang Lupa, Malinta,
Valenzuela City, signed by the Regional Director of Revenue Region No.5
of the Bureau of Internal Revenue, Gerardo R. Florendo; (2) the Complaint-
Affidavit dated July _, 2013, executed by the Legal Officer of the Bureau
of Internal Revenue, Atty. Lei Adrian V. Gapoy; and, (3) other supporting
documents attached to the Information.

After a perusal of the above-enumerated documents attached to


plaintiffs "MANIFESTATION AND COMPLIANCE" posted on March
5, 2014, the Court finds that the same are still machine copies. Clearly,
plaintiff failed to comply with the Court's order, as per its Resolution dated
February 24, 2014, directing plaintiff to submit the originals or the certified
true copies of the foregoing documents within the given period; otherwise,
the case shall be dismissed.

WHEREFORE, in light of the foregoing, the case entitled People of


the Philippines vs. Janet C. Ley, docketed as CTA CRIM. No. 0-349, is
hereby DISMISSED, without prejudice.

The determination of the existence of probable cause for the issuance


of warrant of arrest and the resolution of the accused's "OMNIBUS
MOTION: (1) FOR REINVESTIGATION; (2) TO SUSPEND
PROCEEDINGS; AND (3) TO HOLD IN ABEYANCE THE
ISSUANCE OF WARRANT OF ARREST OR, IN THE EVENT THAT
A WARRANT OF ARREST HAS BEEN ISSUED, RECALL THE
WARRANT OF ARREST" filed on March 6, 2014 and
"MANIFESTATION [Re: Omnibus Motion dated 05 March 2014]
WITH SUPPLEMENTAL SUBMISSION" filed on March 21, 2014 are
now MOOT and ACADEMIC.
