Muhammad Ali Jinnah, that Pakistan would be a democratic state based on Islamic principles
of social justice. I will bear true faith and allegiance to Pakistan and uphold the sovereignty
and integrity of Pakistan and that I will strive to preserve the Islamic Ideology which is the
basis for the creation of Pakistan.

MIAN FASIH-UL-MULK, J.- The nomination

papers of appellant to contest the General Election

2013 from PK-93 Wari Dir (Upper), have been

rejected by the Returning Officer on the ground that

appellant in his nomination papers did not disclose

his NTN number, which he possesses, as per report

of FBR, thus coming within the ambit of false

statement.

2. Arguments heard and record perused.

3. The appellant relates to an area which is a tax

fee zone for the purpose of income tax. According to

respondents, being resident of a Tribal Area/PATA

and the Certificate provided by the FBR.being dated

05.04.2013, is later than the date of filing the

nomination papers, therefore, the subsequent

registration, if any, would not bring his case within

the ambit the disqualification clause. The stance

taken by the appellant seems to be reasonable

because of the dates of filing the nomination papers

and issuance of NTN Registration Certificate. As per

record, the appellant is having no other

disqualification within the meaning of Articles-62

and 63 of the Constitution read with relevant

provisions of the Representation of People Act,

1976, therefore, the order of rejection of his

nomination papers is not worth sustaining when this

Tribunal has also accepted the nomination papers of

another candidate namely Malik Fakhar Hayat from

the same constituency, which too were rejected on

the same ground.

Appeal under section 14(5) of Representation of People Act 1976

against the Order of Returning Officer PK-93 dated 05-04-2013
whereby the nomination papers of appellant have been rejected
and appellant has been restrained to contest the General Election
from PK-93.

Respectfully sheweth
Brief facts

1. That on 28-03-2013 the appellant filed his nomination papers for the
upcoming General Election 2013 papers for the seat of MPA from PK-
93 KPK.

That the appellant is permanent resident of Dogram, Wari Dir, a Tribal

Area/ PATA within the contemplation of Article 246 of the Constitution
of Pakistan 1973 and the Income Tax Ordinance 2001 has so far not
been extended, therefore, there exists no need for any registration or
NTN number as the Income Tax law under which NTN is required has
not been extended to PATA/ the appellant therefore, as against the
column requiring NTN number if any (column No 10 of nomination
papers) the appellant stated "NIL" and annexed the Exemption
Certificate issued by Additional Deputy Commissioner dated 26-03-
2013 confirming the fact that Income tax has not been implemented in
District Upper Dir and therefore the appellant is exempt. Attested copies
of nomination forms and Exemption Certificate are enclosed as A and
B.
