Respected Sir,
In connection to the captioned subject, the EPC contractor has requested vide
his letter under reference sl. no. – 3, to allow payment in his favour under the head of
reconstruction of road and reconstruction of new culverts. Here, we do acknowledge that the
reconstruction of road for 280 mtr. (from km. 111.550 to km. 111.830) and reconstruction of 4
nos. of culverts (@ ch.58.940, @ ch. 72.320, @ ch. 70.100 & @ ch. 88.450) are completed and
liable for payment. But Schedule – H of construction agreement does not allow to make such
payment until the conditions of same schedule are satisfied.

But it is to reiterate that the balance scope of reconstruction of road for 644mtr.
out of total scope of 924 mtr. is requiring reserve forest clearance which is under process. We do
like to conform you that the EPC contractor has completed the work under reconstruction of road
within the given available front.

Further to it, as per schedule – B of construction agreement the EPC contractor


has completed reconstruction of new culverts for 10 nos. out of total scope of 13 nos. Out of the
10 nos of completed reconstruction of new culverts, the EPC contractor has received payment for
6 nos. Irrespective of having resources, the EPC contractor could not able to tackle those 3
culverts at ch. 73.460, ch. 87.550 and ch. 88.180 due to presence of public utility and other
hindrances.

In the light of the above, considering the obligation of construction agreement,


factual condition of site and maintaining a balanced cash flow to the project, we opine to
recommend that the prayer to release payment for 280 mtr. of reconstruction of road and 4 nos. of
culverts under the head of reconstruction may please be considered in the favour of the EPC
contractor.
