JOINT AFFIDAVIT
That we, GENARA F. RAMOS, widow, AND JUANITA F. DE LOS SANTOS,
married, both of legal age, Filipinos, and a residents of barangay Magatas, Sibulan,
Negros Oriental, after having been duly sworn to in accordance with law, do hereby
depose and manifest:
That we called for an investigation of the vehicular incident that happened on
September 16, 2008 at barangay Agan-an, Sibulan, Negros Oriental between respondent
Santiago Calibat and our father victim, Vicente Fontelo;
That an investigation was conducted by PO1 Gregana at the Philippine National
Police Station in Sibulan, Negros Oriental in September 18, 2008 at about 10:00 o’clock
in the morning;
That during the said investigation conducted by PO1 Gregana, respondent
Santiago Calibat admitted that while he came from his residence in barangay Agan-an,
Sibulan, Negros Oriental driving the Easy Ride, he did not see the victim Vicente Fontelo
coming, so he moved towards the North direction and then the accident happened;
That on the basis of this admission, it is not true that the Easy ride was parked at
the right side of the road going the North direction; and that we heard him admitted this
facts during the investigations or conference;
That this affidavit is executed freely and voluntarily just to attest the veracity and
truthfulness of our statements herein.
