Cayetano vs Monsod

 FACTS: Monsod was appointed and confirmed as the Chairman of COMELEC.


 Cayetano prayed that the said confirmation be declared null and void since Monsod does not
possess the required qualification of having been engaged in the Practice of Law for at least
10 years?

 ISSUE: WON Monsod is engaged in the practice of law for at least 10 years?

 RULING: Yes. Practice of law is not merely limited to litigation in court. It involves any activity
whether in or out of the court which requires the application of any law, or any legal matters.
 Hence, based on the facts, Monsod was considered to be engaged in the practice of law for at
least 10 years and he is qualified to be a Chairman of the COMELEC, and the petition of
Cayetano was dismissed.
