The three witnesses were drinking at a store near their friend Jhunel's home. Jhunel joined them and left briefly to get food. When he returned, he said he found a gun in his tricycle and wanted to surrender it to police. The witnesses told him to finish drinking first so they could accompany him. While they drank, two undercover police officers arrived, saw the gun on Jhunel, and immediately arrested him. JOINT AFFIDAVIT OF WITNESSES

WE, TYRONE DAVE F. PALANAS, MARK DAVE BATA and STANLEY L.


LANNU, all of legal ages, Filipino citizens and residents of Bayombong, Nueva Vizcaya, after
being duly sworn to in accordance with law hereby depose and say:

1. That on February 14, 2016, at around 10:30 o’clock in the evening, we were having a
drinking spree at the Sari Sari Store of Mr. Pagaduan at Sta. Rosa, Bayombong,
Nueva Vizcaya near the residence of our friend JHUNEL J. UHUAD (Jhunel for
brevity);
2. That at around 11:00pm, Jhunel arrived and parked his tricycle; We called him to join
our group and he immediately went to our place; He took some shots in our ginebra
2x2 and he asked to leave to get the fried chicken “KFC” he bought at his tricycle;
3. Just a few minutes, Jhunel rushly returned in our location saying that he found a gun
inside his tricycle; He was then holding the firearm and showing it to us; He said that
he will surrender the firearm to the police but we told him to help us finish first our
drinks so that we could accompany him to surrender the firearm to the Bayombong
Police Station;
4. However, while we were taking our last shots, two persons in civilian clothes arrived
and identified themselves as police officers; They asked Jhunel to remove his shirt
and when they saw the gun they immediately grabbed and arrested him;
5. That we execute this affidavit freely and voluntarily;
6. That we attest to the truth of all the foregoing facts;

IN WITNESS WHEREOF, we have hereunto set our hands this 31st day of March 2016 at
Bayombong, Nueva Vizcaya.
