Dear Sirs/Ma’ams:
I am writing you this letter respectfully and humbly
requesting your good office to transfer the ownership of Lot No.
1633-B located at Buenavista, Padre Burgos, Southern Leyte, in
favor of our client, EDITA R. SANCHEZ.
In retrospect, our client had bought the aforesaid property
from PILAR RODILA who is the declared owner of the said lot.
PILAR RODILA executed a Deed of Absolute Sale in favor of EDITA
R. SANCHEZ way back in August 27, 2011. It was notarized before
Notary Public Atty. Delon Richel Ramon B. Urot under Doc.
No.194, Page No. 39, Book No. 41 and Series of 2011. A copy of
the said Deed of Sale is hereby attached as Annex “A” and made an
integral part hereof.
Our client, EDITA R. SANCHEZ had not caused the transfer
of the ownership of Lot No. 1633-B located at Buenavista, Padre
Burgos, Southern Leyte up to the present. The said lot is still
currently declared in the name of PILAR RODILA despite of the fact
that she already sold the lot to our client.
Recently, PILAR RODILA unilaterally execute a Cancellation of
Deed Of Absolute Sale with Waiver and Release of Liability alleging
that she never sold the aforesaid lot to our client and that the Deed
of Sale in August 27, 2011 is a fictitious and a falsified document.
The said Cancellation of Deed of Absolute Sale with Waiver and
Release of Liability was executed on May 10, 2021 and notarized
before Notary Public Atty. Delon Richel Ramon B. Urot under Doc.
No.342, Page No. 70, Book No. 143 and Series of 2021. A copy of
the Cancellation of Deed of Absolute Sale with Waiver and Release
of Liability is hereby attached as Annex “B”.
This is to Inform your good office that the Cancellation of
Deed of Absolute Sale with Waiver and Release of Liability is not a
proper document to cancel the Deed of Sale of August 27, 2011
because the cancellation was only signed by the Seller and not the
Buyer. In other words, the cancellation has no effect because there
was no consent from our client EDITA R. SANCHEZ who is the
buyer of the aforesaid lot. Likewise, it is only a competent court
with a COURT ORDER who has the power to effect the Cancellation
of the Deed of Sale.
Furthermore, Atty. Delon Richel Ramon B. Urot subsequently
executed a Revocation of the Cancellation of Deed of Absolute Sale
alleging that the Cancellation of Deed of Absolute Sale with Waiver
and Release of Liability was without the consent of our clien EDITA
R. SANCHEZ. A copy of the Revocation of Cancellation of Deed of
Absolute Sale is hereby attached as Annex “C” and made an
integral part hereof.
At this point, may we humbly request from you r good
office to transfer the ownership of Lot No. 1633-B located at
Buenavista, Padre Burgos, Southern Leyte, in favor of our client,
EDITA R. SANCHEZ by virtue of the Deed of Absolute Sale dated
August 27, 2011 executed by PILAR RODILA in favor of EDITA R.
SANCHEZ.
