26CALL-TO-ORDER: As the Regular Presiding Officer have an urgent matter to attend to, the SB Presiding
27Officer Pro Tempore, Hon. Ronald I. Apritado presided over and called the 28 th Regular Session of the
28Sangguniang Bayan of San Jose, Batangas to order at 09:37 AM, Monday, February 10, 2020;

30ROLL CALL: The Secretary, upon the instruction of the Presiding Officer Pro Tempore, called the roll to
31which the following Sangguniang Bayan Members responded:

35Official Business. Noting the attendance of the majority of the Members of the Sanggunian which was
36attested by the Secretary, the Presiding Officer thereby declared the session open to transact legislative
37business.

41READING AND CONSIDERATION OF THE MINUTES OF THE PREVIOUS SESSION: The Minutes of the
4228th Regular Session was next considered and on motion of Hon. Ruel F. Ilao which was seconded by Hon.
43Jerick P. Mercado moved to dispensed with the reading of the said Minutes as copies thereof was provided
44beforehand. After some minor corrections, the Minutes of the 28 th Regular Session was considered ratified
45on motion of Hon. Godfrey A. Umali and seconded by Hon. Pepito M. Nitro.

47 At this juncture, the Honorable Municipal Vice-Mayor Noel J. Virtucio arrived at the Session Hall at 09:49
48AM, hence, Hon. Ronald I. Apritado relinquished the Chair to the Regular Presiding Officer.

95 same Barangay – the Hearing for the foregoing case is scheduled today, February 10, 2020 at 1:00
96 in the afternoon wherein the Complainant together with his witness and the respondent were
97 commanded to appear;

99 Item No. 5, the request of Dr. Arlene Briones for reclassification of land from Agricultural to
100 Commercial, situated in Barangay Aya, San Jose, Batangas with an area of 2,000 square meters –
101 the Committee on Housing and Land Utilization is still awaiting for the submission of some required
102 documents from the applicant;

104 Item No. 6, the Sangguniang Kabataan Supplemental Comprehensive Barangay Youth
105 Development Plan 2019 – 2021 and Annual Barangay Youth Investment Plan 2020 of Barangay
106 Don Luis is still under review by the Committee to which the said matter was referred to;

108 Item No. 7, Proposed Revision of the Market Code which was requested and initiated by the Market
109 Administrator – conduct of the Hearing wherein the Market Administrator was invited to appear
110 before the Committees is still ongoing;

112 Item No. 8, Proposed Ordinance, entitled: AN ORDINANCE PROVIDING FOR THE SPEED LIMITS
113 FOR ALL KINDS OF MOTOR VEHICLES WITHIN THE TERRITORIAL JURISDICTION OF THE
114 MUNICIPALITY OF SAN JOSE, BATANGAS, PROVIDING PENALTIES FOR THE VIOLATION
115 THEREOF, COLLECTION OF ROAD CRASH DATA AND APPROPRIATING FUNDS FOR THIS
116 PURPOSE is under further review by the Committee on Ordinances and Legal Matters;

135UNASSIGNED BUSINESS:
136 Item No. 3.1.1, Request of Mrs. Yolanda H. Umali, Operator of EC Sports Complex (Cockpit Arena)
137 for authority to hold cockfights every Wednesday, Thursday, Friday and Saturday of February 2020
138 and 2-Cock Derbies – in view of the grant of provisional franchise of EC Sports Complex which was
139 issued on February 3, 2020, Hon. Ronald I. Apritado sought permission from the Body for the
140 consideration of the aforesaid request. The motion was seconded by Hon. Godfrey A. Umali but
141 was objected into by Hon. Ruel F. Ilao as he pointed out that the said motion was out of order. He
142 explained to the other Members that the rules should be suspended to allow such motion as the
143 matter at hand is under Unassigned Business, thus the said request must be referred to the proper
144 Committee for review and appropriate action.

152 At this point, Hon. Ronald I. Apritado moved for the suspension of the Rules to allow the passage of a
153Resolution authorizing the holding of cockfights as requested by EC Sports Complex which was seconded
154by Hon. Godfrey A. Umali. The motion was then objected by Hon. Ruel F. Ilao. Noting that there was only
155one (1) Member of the Sanggunian who objected to the foregoing, hence, the motion was carried and the

165 indorsed by the Office of the Municipal Mayor, for authority to organize a Trade Fair coinciding with
