TERMS OF REFERENCE
Package No. TIIGP2- VIE-C01: Detailed Design and
Support Consultant

A. Background and Project Description


Asian Development Bank (ADB) approved a loan worth US$ 45 million through a Loan Agreement
No. 3757 VIE (COL) signed on 03 June 2019 for Second Greater Mekong Subregion Tourism
Infrastructure for Inclusive Growth Project in Hoa Binh, Nghe An, Quang Binh, Quang Tri and
Thua Thien Hue provinces. The project will help transform secondary GMS eastern corridor towns
into economically inclusive, competitive international tourism destinations by improving road and
water transport infrastructure, urban environmental services, and capacity to sustainably manage
tourism growth. It will boost trade in services and deepen regional cooperation and integration
among the GMS and Association of Southeast Asian Nations (ASEAN). The Loan closing date
will be on 31 December 2023.

The project has three outputs: (i) urban-rural access infrastructure and urban environmental
services improved; (ii) capacity to implement ASEAN tourism standards strengthened; and (iii)
institutional arrangements for tourism destination management and infrastructure O&M
strengthened.

Hoa Binh Province Subproject


Total investment cost of the Hoa Binh Province Subproject is US$10.384 million, includes (i)
US$8.014 million from ADF loan and (ii) US$2.37 million from counterpart fund. The following
works are expected for the above-mentioned output (i) in Hoa Binh:

1. Chua Tien Tourism Market: Construction of a market at Lao Ngoai hamlet, Phu Lao commune
with construction area about 3,200sqm, including a main market house, management unit
house, guard house, pump station, rest room and ancillary items.

2. Parking Yard: Construction of a parking yard on an area of about 24,150sqm, including guard
house, staff parking area, rest room, electric car ticket selling house, electric car waiting house,
management house and ancillary items.

3. Access Roads: Construction of access roads with total length about 11,100m, pavements of
asphalt & cement concretes, comprising of 02 Roads & 01 Bridge as follows:

- Road T1 (center road to Phu Lao tourism area) has length of 7,600m, start point at Km0+000
crossing Ho Chi Minh Highway at Km461+730, end point at Km7+600; it is grade V mountainous
road according to TCVN4054:2005 Standard.

- Road T2 (center road from Den Trinh, Den Mau, Chua Tien, and Thuy Cung ticket gates) has
length of 3,470m, start point at Km0+000 at the ticket gates, end point at Km3+470 crossing Road
T1 at Km7+110; it is internal urban road according to TCXDVN104:2007 Standard.

- New construction of a pre-stress concrete girder bridge at Station Km1+317.15 on Road T1,
length about 80m, width of 8m, design load of HL-93, pedestrian of 3KN/sqm, seismic load of
level VII (level MSK-64), flood frequency of 1% according to TCVN9386:2012 Standard.

- Installation of LED lightings; road furniture and pavement marking according to


QCVN41:2016/BGTVT Specification.

B. Objectives of Assignment
Primary objectives of the assignment are to support Project management unit for construction
and upgrading Tien pagoda tourism infrastructure (Lac Thuy PMU) for performing the following
tasks:

(i) site survey and/or investigation, detailed engineering designs, cost estimates and author
supervision during construction;

(ii) preparation of bidding documents and procurement process assistances;

(iii) environmental, social safeguards updating, monitoring and compliance;

(iv) project management support; and

(v) public-private partnership arrangements for operations of project-supported facilities.


C. Detailed Scope of Services
(i) Site survey and/or investigation, detailed engineering designs, cost estimates and
author supervision during construction
The Consultant is encouraged to apply appropriate international standards and/or Vietnamese
standards that are known in Vietnam and to refrain from using unknown foreign and/or national
standards. The Consultant is responsible for topographical, geological and hydrographical
surveys, preparation of Detailed Engineering Design, detailed cost estimates and supporting
documents for cost estimates in accordance with the current standards of Vietnam Government.
Tasks include:
1. Review documents, conduct surveys and/or investigations: Based on the approved FS report
and related documents for the subproject, the consultant shall review relevant data and conduct
necessary surveys and/or investigations for the detailed design purpose, including topographical
survey, geological survey, hydrological survey, material survey, and disposal area survey:
Control network: GPS horizontal network, Control point network, Technical leveling for GPS,
Technical leveling for Control point network.
Topographical survey: Based on the approved alignment in FS report, conduct additional surveys
for preparation of detailed design and cost estimation; linear sketch and locate the alignment at
site; Mapping; Profiling; Cross-sectioning; Survey of crossing road; survey for structures and
intersection along the route; reuse of mapping in the FS stage, measuring profiles and cross-
sections.
Hydrological survey and calculation: Basic data was surveyed and investigated in the FS stage,
the consultant is required to review and make necessary additional survey and investigation for
the purpose of preparation a hydrological calculation in this stage
Geotechnical survey, material and disposal area survey: Conduct additional drilling, sampling and
testing to evaluate geological in details, providing data for design; provide material and disposal
area surveys based on the results in FS stage.

2. Prepare Detailed Engineering Design for the Works: Documents of detailed engineering
designs need to comply with the requirements stipulated at Decree No. 59/2015/ND-CP dated
June 18, 2015 of the Government on the management of construction investment projects;
Decree No. 42/2017/ND-CP of the Government: Amending and supplementing a number of
articles of Decree No. 59/2015/ND-CP dated June 18, 2015 of the Government on management
of construction investment projects.
Documents of detailed engineering designs need to inherit the approved design orientations in
the basic design step. Proposed changes from the basic design need to be interpreted
scientifically to prove that these proposals are more effective and feasible and must be approved
by the client.
Design solutions proposed by the consultant are not only comply with technical requirements in
design and construction standards, but also need to be integrated with the requirements of
improving traffic safety, enhancing likelihood responding to climate change, minimizing adverse

impacts on the environment according to ADB safeguard policies and suitable with the
requirements set out in the PAM for the project to ensure the achievement of the overall objectives
of the Project.
The consultant is required to implement community consultation during the detailed design phase.
In order to ensure the approval process, the consultant should closely coordinate with the PMU
and related units to explain and update the changes and adjustments promptly and solve
problems arising in the detailed engineering design phase and also in the construction phase.
The entire expected plan for the construction package needs to be generalized in the document
of construction drawing design, showing specific requirements on resources (materials,
machines, and personnel), construction time, construction schedule for main items such as
embankment, pavement, bridges, works on the road. The recommendations of consultants need
to consider regional climate conditions and the specific construction conditions of the work to
ensure these proposals are feasible.
Risks that may affect the quality of construction, construction progress, labor safety and other
social risks (if any) during the construction process also need to be analyzed, and at the same
time, recommended preventive measures to ensure that risk factors in the construction phase are
always strictly controlled.

3. Prepare Cost Estimates for the Works: The cost estimates for the required works shall be made
in accordance with the provisions of Decree No. 68/2019/ND-CP and guiding circulars. Unit prices
and construction norms should be updated according to the latest documents and institutions at
the time of work execution.
4. Prepare Specifications and maintenance procedures for the Works: The consultant must
prepare those documents in compliance with the regulations on technical guidance and
maintenance procedures for works as required in Decree 46/2015/ND-CP on construction quality
management.
5. Author supervision: The consultant will perform the author supervision during construction
phase as specified in Article 28 of Decree 46/2015/ND-CP on quality management and
maintenance of the construction work.
(ii) Preparation of bidding documents and procurement process assistances
The consultant will assist the PMU to perform the following tasks:
1. Preparation of bidding documents for consulting service packages: The consultant will support
Lac Thuy PMU to prepare bidding documents for construction supervision and external auditor
packages according to ADB guidelines and the Government laws, including Terms of References
and Cost Estimates and submit ADB for no objection letter (NOL) before invitation for expression
of interests (EOI).
2. Preparation of bidding documents for work packages: The consultant will support Lac Thuy
PMU to prepare bidding documents for work packages according to ADB guidelines and the
Government laws, including Technical Specifications and Bill of Quantities and updated
Environmental Management Plan (EMP) to submit ADB for no objection letter (NOL) before
invitation for bids.

Technical Specifications:
The Consultant will develop technical specifications for each type of material, equipment and work
item to be incorporated in the works. The technical specifications must specify the applied
Code/Standard, the properties of material and the required tests as well as the expected
sequence of construction works along with the procedures of inspection and acceptance as well
as measurement and payment methods.
Bill of Quantities:
The Consultant will prepare the detailed bill of quantities (BOQ) for each contract package based
on the detailed design. The BOQ to be calculated to an accuracy of +/- 5% will encompass all
work items properly referenced to the technical specifications and in accordance with relevant
applicable laws.
Inclusion to Bidding Documents the Updated Environmental Management Plan (EMP)
The Consultant will ensure that the bidding documents include specific provisions of the EMP to
minimize disruption and damage to the environment and local communities resulting from the
construction activities; and require the contractors to prepare, implement and monitor EMP for
site works, quarries, borrow pits and disposal areas they will operate under their respective
contract.
3. Procurement process assistances for consulting service packages: The consultant will support
Lac Thuy PMU during EOI stage, evaluation and select shortlisted consultants, issuance of
request for proposal (RFP), opening and evaluation of technical proposals, preparation of
evaluation reports on the technical proposals, opening and calculation of total scores for the
shortlisted consultants, contract negotiation and signing for construction supervision and external
auditor packages according to ADB guidelines and the Government laws, and submit ADB for no
objection letter (NOL) before implementation of the consulting services.
4. Procurement process assistances for work packages: The consultant will support Lac Thuy
PMU during invitation for bids, pre-bid meetings (if any), opening and evaluation of the bids,
preparation of bid evaluation reports, contract negotiation and signing for work packages
according to ADB guidelines and the Government laws, and submit ADB for no objection letter
(NOL) before implementation of the construction.
(iii) Environmental and social safeguards updating, monitoring and compliance
The consultants will update the projects Initial Environmental Examination (IEE) and
Environmental Management Plan (EMP) at detailed design stage and assisting the PMU with
overall environmental management of the implementation of the subprojects. Specific tasks
include:
1. Update the IEE and EMPs to ensure that they address the detailed designs and engineering of
subprojects - updates to EMPs include mitigation and monitoring plans, budget, and capacity
development needs of executing agency and PMU;
2. In collaboration with the NES, design comprehensive training plans targeting PMU and relevant
local authorities on the purpose, content, and roles and responsibilities for implementation of
updated EMPs;

3. Ensure that all relevant safeguards of the EMPs are adequately addressed in the bidding
documents, and in the evaluation criteria for awarding contracts;
4. Coordinate and work with the PMU to ensure that contractors finalize their respective site-
specific Contractor's Environmental Management Plans (CEMPs) based on the updated EMPs
and the actual site conditions;
5. Oversee the implementation of all EMP safeguards relating to construction phase activities
including handling of construction spoil and waste, water and air quality protection, public
nuisance impacts (noise, dust, traffic, blocked access, workers, and camps), and public safety;
6. Coordinate with the relevant provincial authorities on all relevant environmental regulatory
compliance issues (e.g. for noise and dust from construction sites, sanitation in workers campsite
etc.);
7. Together with the PMU safeguards officer, prepare TORs for the follow-up interviews and
consultations with the same affected stakeholders and residents contacted during project
preparation on issues and concerns arising during project construction – of concern is upgrades
to access roads;
8. Prepare TOR(s) for the survey, detection, and removal of unexploded ordnance (UXO) at all
civil works sites, and ensure that PMU consult relevant authorities to assist with TOR finalization,
approval and implementation;
9. Advise PMU civil works and safeguards officers on environment-related concerns arising during
subproject construction, and recommend corrective measures;
10. With PMU civil works and safeguards officers, ensure dissemination to stakeholders the
results of environment quality monitoring and implementation of safeguards, especially among
households or small businesses near the civil construction works areas;
11. Assist PMU safeguards officer to prepare an outline for regular reports PMUs must submit to
ADB on implementation of EMPs, environmental, issues, and corrective actions;
12. Assist PMU civil works and safeguards officers prepare a report template for construction
contractors to report monthly on mitigation activities, and environmental issues that occur during
the construction phase;
13. Assist PMU safeguards officer to prepare quarterly and semi-annual safeguards monitoring
reports and period spot checks on the implementation of EMPs, environmental issues, and public
safety protection to be submitted through the PMU to the relevant provincial authorities and ADB.
(iv) Support the PMU in project management
1. Assist the PMU in preparation of consolidated quarterly progress reports in a format consistent
with ADB project performance reporting system;
2. Assist the PMU in preparation of consolidated annual reports including (a) progress achieved
by output as measured through the indicator's performance targets, (b) key implementation issues
and solutions, (c) updated procurement plan, and (d) updated implementation plan for the next
12 months;

3. A comprehensive consolidated midterm report following formats agreed by the EAs, MCST and
ADB in advance; and
4. A consolidated project completion report within 6 months of physical completion of the project.
5. In close consultation with the PMU, oversee the implementation of a Project Performance
Monitoring System (PPMS), including project impact, outcome and output indicators, as defined
in the DMF, as well as safeguards and gender and social development indicators;
6. Support the PMU to comply with project loan covenants, assurances and safeguard
requirements, as well as with national and provincial policies and regulations.
(v) Public private partnership arrangements for operations of project supported facilities
Advise the PMU on Road Safety Plans, sustainable Operations and Maintenance of project
supported infrastructure and public private partnership arrangements for operations of project
supported facilities.
D. TEAM COMPOSITION - MINIMUM QUALIFICATIONS

1. Selection Procedures:
The consultant will be recruited by Lac Thuy PMU in accordance with ADB Guidelines on the Use
of Consultant in 2013 or as amended from time to time, using Quality & Cost Based Selection
(QCBS) method with standard quality-cost ration of 80:20, Full Technical Proposal (FTP), Lump-
Sum Contract form.
2. Qualification and Experience Requirements of the Consultant:
(i) Minimum 10 years of experience in design, implementation support, construction
supervision and contract management for infrastructure projects;
(ii) National firms should have valid certificate of operation capacity on design of transport
and technical infrastructures of grade III or higher, international firm should have
comparable certificates issued by authorities in the country of the firm;
(iii) National firms have valid certificate of operation capacity on project management and
construction supervision of transport and technical infrastructures of grade III or higher,
international firm have comparable certificates issued by authorities in the country of the
firm would be preferable;
(iv) Experiences in conducting/reviewing of detailed designs and implementing support of
procurement, financial management, safeguards, monitoring & evaluation, project
management for at least one (01) multisector infrastructure project/subproject, mainly
transport works funded by ADB or WB within last 5 years.
(v) Experiences in similar geographical areas would be preferable.
3. Main input of the consultant
The provision of consulting services for completion of the works covering both engineering and
soft-engineering components will require to mobilize a team of international and national
consultants. Tentative list of key and non-key experts along with their respective duties and
required qualifications is provided in Tables 3 and Table 4. It is anticipated that about 2 person-
months of key international specialist, 78 person-months of key national specialists, and 70
person-months of non-key national specialists will be required. The implementation period is
expected from December 2020 to December 2023 or until completion of the Subproject.

Table 4: Personnel Duties and Qualifications:

1. International Environmental Specialist

The International Environmental Specialist (IES), with assistance from the National Environmental
Specialist (NES), will be responsible for updating the projects Initial Environmental Examination
Loan 3757 VIE (COL): Second Greater Mekong Subregion Tourism Infrastructure for Inclusive Growth
Project - Hoa Binh Province Subproject

(IEE) and Environmental Management Plan (EMP) at detailed design stage; and assisting the
PMU with overall environmental management of the implementation of the subprojects. Specific
tasks include:
(i) Update the IEE and EMPs to ensure that they address the detailed designs and
engineering of subprojects - updates to EMPs include mitigation and monitoring plans,
budget, and capacity development needs of executing agency, PMU;
(ii) In collaboration with the NES, design comprehensive training plans targeting PMU and
relevant local authorities on the purpose, content, and roles and responsibilities for
implementation of updated EMPs;
(iii) Ensure that all relevant safeguards of the EMPs are adequately addressed in the bidding
documents (instruction to bidders), and in the evaluation criteria for awarding contracts;
(iv) Coordinate and work with the PMU to ensure that contractors finalize their respective site-
specific Contractor's Environmental Management Plans (CEMPs) based on the updated
EMPs and the actual site conditions;
(v) Oversee the implementation of all EMP safeguards relating to construction phase activities
including handling of construction spoil and waste, water and air quality protection, public
nuisance impacts (noise, dust, traffic, blocked access, workers, and camps), and public
safety;
(vi) Coordinate with the relevant provincial authorities on all relevant environmental regulatory
compliance issues (e.g. for noise and dust from construction sites, sanitation in workers
site camp etc.);
(i) With the PMU safeguards officer, prepare TORs for the follow-up interviews and
consultations with the same affected stakeholders and residents contacted during project
preparation on issues and concerns arising during project construction of concern is
upgrades to access roads;
(ii) Prepare TOR(s) for the survey, detection, and removal of unexploded ordnance (UXO) at
all civil works sites, and ensure that PMU consult relevant authorities to assist with TOR
finalization, approval and implementation;
(iii) Advise PMU civil works and safeguards officers on environment-related concerns arising
during subproject construction, and recommend corrective measures;
(iv) With PMU civil works and safeguards officers, ensure dissemination to stakeholders the
results of environment quality monitoring and implementation of safeguards, especially
among households or small businesses near the civil construction works areas;
(v) Assist PMU safeguards officer prepare an outline for regular reports PMUs must submit
to ADB on implementation of EMPs, environmental, issues, and corrective actions;
(vi) Assist PMU civil works and safeguards officers prepare a report template for construction
contractors to report monthly on mitigation activities, and environmental issues that occur
during the construction phase;
(vii) Assist PMU safeguards officer prepare quarterly and semi-annual safeguards monitoring
reports and period spot checks on the implementation of EMPs, environmental issues,
and public safety protection to be submitted through the PMU to the relevant provincial
authorities and ADB.

Required Qualifications and Experiences: A university degree in natural


resource/science/environmental management or relevant fields, over 10 years of experience
implementing and managing environmental assessment of infrastructure projects, preferably in
the GMS, a good understanding of ADB’s Safeguard Policy Statement 2009 (SPS 2009) and
national environmental safeguard requirements, and experience working with and supervising the
activities of provincial and national environmental management agencies with environmental
safeguards. Experience in Viet Nam and with ADB project implementation will be advantages.

2. National Lead Civil Engineer / Team Leader

The National Lead Civil Engineer/Team Leader (TL) will: (i) be responsible for the management
and supervision of the international and national Detailed Design and Support Consultant (DDS)
consultants; and
(ii) management and supervision of all aspects of the civil works detailed design, documentation,
and contracting related to the infrastructure subprojects under Output 1. Undertaking the assigned
project management tasks, the TL will coordinate closely with the appropriate PMU staff. Specific
tasks include:

Project management tasks

(i) Supervise and coordinate the work of the international and national DDS consultants, and
ensure that the consultants’ outputs are in accordance with agreed Terms of Reference
and project requirements;
(ii) Prepare and regularly review the DDS consultants' personnel schedule to coordinate PMU
and international and national consultants' inputs and respond to changing project
circumstances if these occur;
(iii) In close consultation with the PMU, prepare the overall and annual project activity plans
and budgets and monitor activity implementation;
(i) In close consultation with the PMU, oversee the finalization and implementation of a
Project Performance Monitoring System (PPMS), including project impact, outcome and
output indicators, as defined in the DMF, as well as safeguards and gender and social
development indicators;
(ii) Support the PMU to comply with project loan covenants, assurances and safeguard
requirements, as well as with national and provincial policies and regulations;
(iii) In coordination with the PMU Director and/or Deputy Director, organize regular project
management team meetings including the international and national consultants and PMU
staff;
(iv) In collaboration with the PMU Procurement Officer, review Output 1 project goods and
services procurement proposals and ensure they are in accordance with the approved
procurement plan;
(v) In coordination with the PMU Accountant recommend payments to contractors;
(vi) Review and consolidate all DDS consultants’ reporting submissions and consolidate into
integrative high-quality reports in accordance with agreed reporting schedules and submit
to PMU for onward submission to PCU for consolidation into quarterly and annual progress
reports and project completion report;
(vii) Undertake other specific technical management inputs where these may be required;

Infrastructure design tasks:

(i) Supervise the national civil engineers;


(ii) Initiate project detailed design and implementation activities by assisting the PMU in a
comprehensive review of all project documentation including feasibility studies,
preliminary designs, cost estimates, procurement plans, and safeguard requirements;
(iii) Guide in identifying the scope of site surveys needed to prepare detailed designs;
(iv) Administer the provisional sums for technical surveys, etc.;
(v) Manage detailed subproject engineering requirements;
(vi) Manage design standards and preliminary cost estimates;
(vii) Assign responsibilities to the national consultants in coordination with the PMU
regarding the preparation of detailed engineering documentation, specifications, bills
of quantities and cost estimates;

(viii) Manage the preparation of contract packages for tendering in accordance with ADB
and Government procurement guidelines and define requirements for a conforming
tender with criteria for evaluation of bids based on price and performance;
(ix) Coordinate with PMU to ensure that all necessary approvals from provincial and local
authorities have been obtained;
(x) Manage bid evaluation reports against established criteria and recommend the award
of contracts;
(xi) Undertake other specific technical civil engineering inputs where these may be
required.

Required Qualifications and Experiences: A master degree in civil engineering or project


management or engineering disciplines relevant to the project, over 15 years of experiences in
infrastructure projects in Vietnam, including 10 years of experiences as team leader, deputy team
leader or similar positions for infrastructure projects; leading experiences in at least three (03)
multisector infrastructure projects regarding to design management/review and implementation
support for procurement, financial management, safeguards, monitoring & evaluation, and project
management funded by ADB or WB. Experiences in the same geographical conditions in Vietnam
would be preferred.

3. National Civil Engineer

The National Civil Engineer (NCE) will assist the Team Leader (TL) in the preparation of Output
1 detailed engineering designs and procurements. Specific tasks include:

(i) Assist the TL in a comprehensive review of all project documentation including feasibility
studies, preliminary designs, cost estimates, procurement plans, and safeguard
requirements;
(ii) Assist in identifying the scope of site surveys and procurement of technical surveys
needed to prepare detailed designs;
(iii) Under the direction of the TL, leading preparation of detailed infrastructure designs;
(iv) Assist TL with the identification of detailed subproject engineering requirements;
(v) Assist TL with conducting design standards and preliminary cost estimates;
(vi) Under direction of the TL leading the preparation of detailed engineering documentations,
specifications, bills of quantities, and cost estimates;
(vii) Assist the TL leading the preparation of contract packages for tendering in accordance
with ADB and Government procurement guidelines and define requirements for a
conforming tender with criteria for evaluation of bids based on price and performance;
(viii) Assist the TL leading the preparation of bid evaluation reports against established
criteria and recommend the award of contracts;
(ix) As directed by the TL, undertake other specific technical civil engineering inputs where
these may be required.

Required Qualifications and Experience: A bachelor's degree in civil engineering or related


engineering discipline relevant to the project, holding the design certificate of relevant works at
least grade III or higher, over 10 years of experiences in similar projects. Experience with ADB
project implementation will be an advantage.

4. National Institutional Specialist


Loan 3757 VIE (COL): Second Greater Mekong Subregion Tourism Infrastructure for Inclusive Growth
Project - Hoa Binh Province Subproject

The National Institutional Development Specialist (NIDS) will advise on sustainable operation and
maintenance (O&M) of project-supported infrastructure and public-private partnership (PPP)
arrangements for operation of project-supported facilities. Specific tasks include:

O&M of project-supported infrastructure tasks:

(i) With the PMU, responsible agencies for O&M of project supported infrastructure, and
together with the National Lead Civil Engineer/Team Leader, plan for and develop systems
and procedures for sustainable operation and maintenance (O&M) of project supported
infrastructure, including, where appropriate, through public-private partnerships;
(ii) Design and coordinate implementation of training programs for sustainable operations and
maintenance of facilities constructed by the project, including on public-private partnership
for O&M;
(iii) Advise on the hand over arrangements of the project supported infrastructure to the
agencies who will be responsible for O&M;

PPP arrangements for operation of project-supported facilities tasks:

(i) Review all relevant project documentation, especially the preliminarily identified PPP
opportunities and validate the assumptions used in the feasibility study for the project
during loan preparation stage and revise if necessary;
(ii) Prepare comprehensive financial projections that will provide clear indication of the
potential for undertaking PPP to operate project-supported facilities;
(iii) In close coordination with the two PMU, determine the PPP modality best suited for each
identified opportunity;
(iv) Review all institutional and regulatory issues relating to PPP transactions and coordinate
with government agencies in the set-up and compliance with regulations such as but not
limited to environmental clearance certificates;
(v) Assist the PMU in the preparation of project briefs, request for proposals, bid evaluation,
design of a suitable bid process that will ensure comparable bids and draft contracts for
management/lease/concession to operate selected facilities in compliance with
government regulations;
(vi) Participate in the negotiations with potential private partners to assist the government with
final selection and contracting of service providers/site managers.

Required Qualifications and Experience: A university degree in civil engineering, public


administration, economics, finance, or other relevant fields with 10 years of work experiences
including experience in government related infrastructure projects, substantial involvement in the
preparation of O&M plans and PPP for operation of small public facilities. Experience with ADB
project implementation will be an advantage.

5. National Social Safeguards Specialist (Resettlement & Indigenous People)

The National Social Safeguards Specialist (NSSS) will support the PMU in updating the
Resettlement Plans (RP), developing capacity of provincial and local officials responsible for RP
and REMDP implementation and putting in place mechanisms for internal monitoring during
implementation. Specific tasks include:

(i) Ensuring that due diligence in implementing the RPs and REMDP is carried out for each
subproject;

(ii) According to the provisions in the social safeguard plans, assist in preparing the materials
and strategy for and assist in the conduct of information campaigns, public consultation
and community participation;
(iii) Prepare the survey materials and method to complete the detailed measurement survey
with information from the infrastructure detailed design and update the census of affected
persons;
(iv) Coordinate the detailed measurement survey with information from the infrastructure
detailed design and update the list of affected persons;
(v) Update the RP and REMDP, and follow-up to ensure timely approval;
(vi) Operationalize the REMDP;
(vii) Brief officials at all levels on the content and procedures for implementing the social
safeguard plans and improve, if necessary, procedures for the coordination of
resettlement, compensation and implementation of REMDP activities;
(viii) Verify the calculations of compensation made by the authorities in relation to the
provisions of the RP and REMDP entitlement matrix, and advise the PMU on any required
measures to take to ensure compensation levels are made according to the RP and
REMDP provisions;
(ix) Monitor compensation payment and advise the PMU of actions to take to ensure
compensation is paid in full and in a timely manner;
(x) Ensure that mechanisms to address grievances promptly and properly are in place and
functioning well, and provide periodic training on grievance redress if needed;
(xi) Establish and implement procedures for ongoing internal monitoring, including inclusion
of relevant indicators in the project performance management system and project baseline
report;
(i) Establish and implement liaison mechanisms to ensure proper technical and logistical
support to PMU, local administrative authorities and concerned government departments;
(ii) Design and deliver capacity development activities for all relevant agencies, as needed,
in the areas of ADB resettlement and indigenous people policies, participation and
communication and grievance procedures;
(iii) Train PMU assigned social safeguard focal persons to carry out internal monitoring and
reporting of social safeguards plans;
(iv) Monitor grievance process from all the affected households
(v) Prepare semi-annual status reports and period spot checks on the implementation of RP
and REMDP, to be submitted through the PMU to ADB.

Required Qualifications and Experience: A university degree in the social sciences or relevant
fields, familiarity with ADB’s Safeguard Policy Statement 2009 (SPS 2009) and the related
national laws and policies and over 10 years of experiences supporting RP and REMDP
implementation, preferably on ADB financed projects.

6. National Environmental Specialist

The National Environmental Specialist (NES) will assist the International Environmental Specialist
(IES) including acquisition of new information to update the environmental management plans
(EMP) at detailed design, and work with the PMU with overall environmental management of the
implementation of the subprojects. Specific tasks include:

(i) Assist with updating the IEE and EMPs to ensure that they address the detailed designs
and engineering of subprojects - updates to EMPs include mitigation and monitoring plans,
budget, and capacity development needs of executing agency, PMU;

The National Gender and Social Development Specialist (NGSDS) will review and operationalize
the Gender Action Plan (GAP), the Consultation and Participation Plan, and the Stakeholder
Communication Strategy and support the PMU to develop the skills and mechanisms to carry
these out. Specific tasks include:

(i) Review and support PMU in operationalization of the GAP including gender in
Resettlement Plan, Consultation and Participation Plan and Stakeholder Communication
Strategy so that GAP can be implemented satisfactorily;
(ii) Design and conduct training modules on gender sensitization for various stakeholders and
capacity development programs under institutional strengthening activities (Output 2 & 3);
(iii) Prepare and deliver training modules on inclusion of women from ethnic groups in tourism
activities as part of the training and capacity development programs under institutional
strengthening activities (Output 2 & 3), ensuring they are (a) gender sensitive in content
and methodology, (b) relevant to the livelihood needs and priorities of women and ethnic
groups, and (c) targeting women participants, maximizing their economic benefits;
(iv) Facilitate community consultation during detailed design and provide inputs in the detailed
design to ensure that design elements maximize benefits and minimize negative impacts
to women;
(v) Provide guidance and training on effective participatory methods and develop
communication techniques to effectively realize the plans’ objectives;
(vi) In consultation with the PMU safeguards officer, develop a sex and ethnic disaggregated
monitoring system, including reporting templates for inclusion in the project performance
management system and project baseline report and support PMUs to monitor and report
on GAP and DMF gender targets implementation and achievements;
(vii) Collect and write human interest stories on gender impacts of the project;
(viii) Support preparation of gender inputs for the project completion report according
to ADB and government requirements;
(ix) Provide other gender related inputs as required.

Required Qualifications and Experience: A university degree in the social sciences or relevant
fields, familiarity with ADB’s Safeguard Policy Statement 2009 (SPS 2009), ADB Gender and
Development Policy (1998) and the related laws and policies of Viet Nam, and over 10 years of
experience implementing GAPs, Consultation and Participation Plans and Stakeholder
Communication Strategies in infrastructure projects. Experience with ADB project implementation
be an advantage.

8. National Non-Key Specialists

8.1 Road, Bridge, Civil, Geotechnical, Electrical Engineers and Cost Estimate Specialist are:
directly responsible for inspection and/or implementation of surveys, detailed engineering
designs, technical specifications, bills of quantities and cost estimates.

Required Qualifications and Experience: A university degree in the relevant fields, holding the
design/ price evaluation certificate of relevant works at least grade III or higher, over 8 years of
experience implementing relevant works in infrastructure projects. Experience with ADB project
implementation be an advantage.

8.2 Financial, Procurement, Monitoring & Evaluation Specialists are: directly responsible for
supporting on financial management and O&M and PPP matters, procurements (draft of bidding
documents, bid evaluation reports, and procurement process assistance), monitoring and
evaluation (updating DMF, Loan Covenant Status and preparation of PPMS)

Required Qualifications and Experience: A university degree in the relevant fields, over 8 years
of experience implementing relevant works in infrastructure projects, including at least 5 years of
working experiences in similar positions for infrastructure projects funded by ADB or WB.

F. CLIENT INPUT AND COUNTERPART PERSONNEL

The services, facilities and property to be made available by the Client to the Consultant will
encompass the following:
(i) In connection with the services to be provided by the Consultant which will require the
cooperation of central and local Government agencies, PMU will liaise with these
Government agencies and will ensure that the Consultant has access to all the information
and data required for the performance of the services with the exception of those data and
information which by law are classified as restricted; and
(ii) The results of the Project Feasibility Study, and Detailed Design Guidelines used in the
feasibility study and copies of all relevant reports developed during the project preparatory
phase will be provided by PMU to the Consultant. In the course of the services to ensure
that the detailed design survey, drawings, technical specifications and procurement-
related documents fully comply with the national standards and regulations and the ADB
requirements any updated feasibility documents and/or amended Vietnamese regulations
will be provided to the Consultant. The above information will be provided to the
Consultant with seven (7) days of a written request from the Consultant to the PMU.
In addition, and unless otherwise specified in the Special Conditions of the contract governing the
provision of the detailed design and documentation services, PMU shall use its best effort to
ensure that the Government shall:
(i) Issue to officials, agents and representatives of the Government all such instructions as
may be necessary or appropriate for the prompt and effective implementation of the
Services;
(ii) Provide the Consultant, Sub-consultants and Personnel with work permits and such other
documents as shall be relevant and necessary to enable the Consultant, Subconsultants
or Personnel to perform the Services;
(iii) Facilitate entry and exit visas for the international staff and their dependents.
(iv) Facilitate prompt clearance through customs of any property required for the Services and
of the personal effects of the Consultant’s personnel and their eligible dependents;
(v) Assist the Consultant and its personnel and any Sub-consultants employed by the
Consultant for the Services to register or obtain any permit to practice their profession or
to establish themselves either individually or as a corporate entity according to the
Applicable Law;
PMU will appoint counterpart personnel who will work with and assist the Consultant.
