1899 Malolos Constitution

According to Merriam Webster (2021), A constitution is the fundamental concepts and


legal guidelines of a nation, state, or social institution that decide the powers and obligations of
the authorities and assure positive rights to the human beings in it. In that case, a country
without a constitution is an unruly country. This is why Malolos constitution is the best and is
the most crucial constitution in the Philippines.
Aguinaldo propagated the Malolos constitution in 1899. The Malolos Constitution is the
first major Philippine document drafted by the electorate. It marked the beginning of the
journey for independence here in the Philippines. It created a Philippine state whose
government was "popular, representative and responsible" with three different powers,
executive, legislative and judicial. These three branches ensure balance or fairness within the
country by explicitly providing protective measures against abuse and lists the national and
individual rights of not just Filipinos and foreigners but also the government. As a precaution,
no merging of powers may happen as they made it illegal for one person or corporation to have
more than one of those branches of constitution.
Legislative powers were exercised by the Assembly of Representatives, which was
composed of delegates elected by law. To continue the function of Congress, the document
provided for a Standing Commission to take a seat as a legislative body when Congress wasn't
in session. President of the Republic was elected by the assembly. The cabinet, made of the
secretaries of the different government departments, wasn't responsible to the president but
to the assembly. The administration of justice was the responsibility of the Supreme Court and
therefore the lower courts to be established in accordance with the law. The President of the
Supreme Court must be elected by the Assembly in agreement with the President and also the
Cabinet. The separation of church and state was also established at this point which was a great
move. It was stated by Vedantu (N/A) that religion ought to be kept separate from the State in
light of the fact that:

 It empowers the nation to work justly.


 Individuals having a place with the minority networks can in any case be hurt by the
control of the greater part and there can be an encroachment of the Fundamental
Rights.
 People can exit from their religion and one more religion can be embraced by them
through Secularism. As indicated by the law, individuals can decipher strict lessons in
various ways.
For these reasonings, the separation of church and state is a must and justified.
The constitution, on its entirety, may be a monument to the ability of Filipinos to search
out their own way in accordance with democratic principles. During a period of hardship, it
symbolized the ideals of people who had emerged from the dark ages within the light of
reason. It should make us feel downhearted to see how the government abuses its power these
days. We didn’t proclaim the Malolos constitution for them to abuse, but to establish peace and
discipline in this country. So, with these statements, Malolos constitution is the best for me.
