Pet S.125 (3) CRPC

The above named petitioners humbly submits as follows:

1. It is submitted that the petition filed the above M.C for maintenance against
the Respondent being a wife and children on 08-11-2006 and the same was
allowed on 24-03-2007 by granting maintenance by directing the respondent to
pay the monthly maintenance of Rs.1,000/- to each petitioners 1 and 2 in total
Rs.2,000/- per month from the date of the petition.

2. It is submitted that the respondent not complying the order even though the
Hon’ble court passed the orders on 24-03-2007 the petitioners are wife and minor
son of the respondent, the Hon’ble court may be pleased to direct the respondent
the arrears of maintenance from 08-11-2006 ( date of filing of M.C) to 08-05-2007
in total Rs.12,000/- for six months.

3. That the Respondent failed to comply orders of the Hon’ble court to issue
arrest warrant and send the respondent to imprisonment and detain in Jail up to
realization of arrears of maintenance of Rs.12,000/-.

Hence it is prayed that the Hon’ble court may be pleased to issue warrant
of arrest as not complying the order of the Hon’ble court, in the interests of justice.
