Sir, 

Pursuant to the instructions from and on behalf of my client Mr. Srikanth Kulkarni
S/o Ramakanth Kulkarni presently residing at H.No.3-2-6/3, Chapal Bazaar Beside
Badruka College, Himayatnagar, Hyderabad -27, I do hereby serve you with the
following Legal Notice: -

 
1- That my client and you are in acquaintance since a long time and this acquaintance
have been betrayed by you resulting in breach of trust.

2 - That you approached my client on 04-09-2020 and said that to you require an
amount of Rs.2,00,000/- (Rupees Two Lakhs Only) for personal requirement and
requested my client to arrange a hand loan of the said amount and further promised
to repay the same within 8 months or on demand.

3 – That upon your request and obliging the same, my client has arranged the
amount of Rs.2,00,000/- (Rupees Two Lakhs Only) on 06-09-2020 and my client
have provided you the amount under a promissory note acknowledged & executed by
you on 06-09-2020.

4 - That as per the promissory note my client have approached you in the month of
December 2020 and demanded to repay the amount but in spite of repeated requests
you failed to repay the debt and informed him that you will repay the amount by the
end of first week of February 2021.

5 – That my client solely upon trust basis once again approached you in the mid-
week of February 2021 to remind about the repayment of Rs.2,00,000/- (Rupees
Two Lakhs Only) and informed that the repayment promise date is approaching fast
on which you had informed my client that you are in dire need of another handloan
an amount of Rs.3,00,000/- (Rupees Three Lakhs only) and further promised to
repay both the amounts totalling Rs.5,00,000/- (Rupees Five Lakhs Only) within
further three months. Further promised to pay an interest on amount of Rs.
2,00,000 @ of 24% P.A. due to the delay.

6 – That my client due to past cordial relations and trust has arranged to pay you
further sum of Rs.3,00,000/- (Rupees Three Lakhs only) under an Hand Loan
Agreement dated 14-02-2021 for which you promised to pay the same within a
period of three months but in vain.

7 – That my client had again approached you in the month of May 2021 for
repayment of Rs.5,00,000/- (Rupees Five Lakhs only) but you avoided meeting him.
In fact my client had tried his level best to meet you in person but since then you
have been avoiding to meet him and due to intermittent lock-downs by the State
Government on account of Covid-19 pandemic by taking undue advantage of the
same you have avoided meeting him.

8 – That despite your conniving behaviour my client tried to reach you in person and
on your mobile still trusting that you will repay the amount of Rs. 5,00,000/-
(Rupees Five Lakhs only) without any hassle but you have always been dilly delaying
the same and so far have not paid even a single paisa out of the said outstanding
undisputed amount.

9 - That inspite of acknowledging the liability of payment of principal amount of Rs.


5,00,000/- (Rupees Five Lakhs only) you have miserably failed to make payment of
the said amount due to my client with malafide intent, hence you are liable to pay as
follows:

(i) The Principal amount of Rs.2,00,000/- (Rupees Two Lakhs Only) you
received on 06-09-2020 with an interest rate of 24% per annum
commencing from 14-02-2021 till the date of actual realization towards
compensation and mental agony.

(ii) The Principal amount of Rs. 3,00,000/-(Rupees Three Lakhs Only) you
received on 14-02-2021 and failed to repay within three months for which
you are required to compensate me with an interest rate of 24% per annum
till the date of actual realization towards compensation and mental agony.

I, therefore, through this Legal Notice finally call upon you to pay to my client the
above Principal amounts along with interest within a period of 15 days from the date
of receipt of this notice to my client either in cash or by demand draft or Cheque
which ever mode suits you better, failing which my client has given me clear

instructions to file civil as well as criminal lawsuit for recovery and other
miscellaneous proceedings against you in the competent court of law and in that
event you shall be fully responsible for the same.

Further you are also liable to pay an amount of Rs.15,000/- towards costs of this
legal notice.
 

A copy of this Notice has been preserved in my office for record and future course of
action.
