2. Duties of Expressway Administration Department

2.1 Purposes of Expressway Administration


(1) The objective of these guidelines is to guide all persons using, possessing or
otherwise dealing with the Nairobi Expressway.
(2) In this manual, unless the context otherwise requires.
Administration means the administration department of Moja Expressway Company
Limited.
Company means Moja Expressway Company Limited.
Expressway means the Nairobi Expressway Road and all the facilities and structures
constructed by the company as part of the expressway.
Inspection team means the team of officials of the company, Kenya National
Highways Authority and Traffic police patrolling the overseeing the use of the
expressway.
Limit means the limits described in Appendix 6 of this manual.
Motorist means a person driving or who authorizes any kind of motor vehicle to be
driven on the expressway.

2.2 Functions of Expressway Administration


(1) Inspecting the Expressway on full time basis.
(2) Aiding and towing vehicles involved in accidents on the Expressway.
(3) Registering and processing claims of any damages occasioned by motorist to the
expressway.
(4) Maintaining and keeping the Expressway and any repairs in good order.

(5) Investigating and stopping any illegal encroachment, pollution, damage, or
occupation of the expressway according to the applicable laws and regulations.
(6) Working with the appropriate law enforcement department to investigate and
punish any illegal conducts and traffic accidents.
(7) Operating and maintaining the toll stations.
(8) Reporting vehicles that fail to stop and comply with the traffic laws after causing
or being involved in accidents along the expressway to the Inspection team for
investigations and prosecution.
(9) Approving and inspecting any construction activities within the expressway,
including setting up of adverts and billboards.
(10) Escorting any heavy-duty vehicle crossing or passing through the expressway.
(11) Approving, monitoring, and inspecting any activities under the expressway
bridge.
(12) Dealing with any lawsuits, demands and or claims against the company.
(13) Sensitizing the public on road safety along Expressway.
(14) Exercising any other powers granted by applicable laws and regulations.

3. Scope of Work

3.1 Procedure for Handling claims of damage to the expressway.


Summary Procedure
(1) Upon detecting or receiving report of damage to the expressway, the
inspection team shall inspect the damage and complete a form indicating the
damage and the cost of repairing the damage.
(2) The cost of the repair for damage caused to the road shall be assessed by an engineer
appointed by the company and or the authorized representative of the company and it
shall be based on the rates indicated in Appendix 2 as may be amended from time to time
based on the market prices for repairing or replacing the damaged infrastructure.
(3) The inspection team shall issue the person liable for the incident a notice
indicating the nature and extend of the damage cause to the expressway and
the cost of repairing or replacing the damages infrastructure in the form set out
in Appendix 1.
(4) A motorist may object to the contents of the notice by the company to reexamine the
damage in writing within 14 days upon receipt of this notice. Upon expiry of the 14 days
the motorist shall be deemed to have waived the right of such objection.
(5) If the motorist or the person liable for incident accepts liability, he or she shall
pay the costs of the damage or replacement as assessed and the company shall
issue a receipt to the motorist or the person paying for the damage and mark

the matter as fully settled.
(6) If the claim is not settled by the summary procedure indicated above or the
motorist is unable to settle the claim within 14 days following occurrence of
incident the company may initiate civil proceedings to recover the loss and
damage under the regular procedure.
Regular Procedure
Where the claim for damage is not settled by the summary procedure, the company
may pursue the claim for compensation in civil proceedings in addition to any other
legal remedy available to the company under the laws of Kenya.

3.2 Rates for towing, parking and compensating for damage to

expressway
(1) The rates applicable to Motorists who damage the expressway shall be assessed
according to the rates set out in Appendix 2.
(2) In cases where a vehicle obstructs the flow of traffic on the expressway by reason
of accident, mechanical breakdown, or any other cause, the company should tow the
accident vehicle to the nearest police station or to a designated parking space to allow
free flow of traffic.
(3) The rates applicable to motorist for towing the vehicles shall be assessed
according to the rate set out in Appendix 3.
(4) For any reason, including accidents, stalling, or any other incident caused by the
motorist it becomes necessary to park the vehicle on any parking on the expressway,
the motorist shall pay the company parking fee at the rate indicated in Appendix 4.

3.3 Vehicles exceeding prescribed limits


(1) Vehicles that exceed the prescribed limit in terms of weight, height, width and
length and load are prohibited from the expressway except on special permission to be
applied for.
(2) Checkpoints will be installed on the toll stations at the entrance to the expressway
to detect vehicles that exceed the prescribed limit.
(3) Where circumstances make it necessary for a vehicle that exceeds the prescribed
limit to be driven on the expressway, the company’s officers shall escort the vehicle
to the exit of the nearest toll station.
(4) The company shall charge a separate toll for vehicles that exceed the limit.
(5) Motorists who intend to drive a vehicle that exceeds the prescribed weight limit
along the expressway shall be required to apply for a special written pass from the
company.

(6) The motorist will be required to submit a written application to the company at
least three (3) days from the date the motorist intends to use the road.
(7) If the application is approved, the company shall inform the motorist of the
approval in writing.
(8) Once the approval is given, the company's officers will be assigned to escort the
vehicle from entry to the expressway to the nearest toll station's exit.
(9) Where any motorist drives a vehicle that exceeds the prescribed limit on the
Expressway without permission, the company shall take such steps as the company in
its absolute discretion, deems necessary to prevent the vehicle from continuing to use
the Expressway, including detaining the car until the car complies with prescribed
limits.
(10) Any person who drives or otherwise causes a vehicle that exceeds the prescribed
limit to be on the expressway shall be liable to compensate the company for all losses
caused by such use.
(11) In addition, the company may take any other legal action provided in the
applicable laws.
(12) Freight vehicles that have not been inspected and obtained weight inspection
certificates are prohibited from the expressway.
(13) The company will charge a separate toll for escorting vehicles that exceed any
prescribed limit along the expressway.
(14) Five hundred and sixty Kenya shillings will be the rate charged as the escort fee
per kilometer.

3.4 Use of the land and structures reserved for expressway


(1) The following acts and omissions are prohibited within the Expressway unless the
person first obtains written permission of the company:
a. Parking in violation of laws or regulations.
b. Occupying the emergency lane without any emergency.
c. Setting up non-highway signs in violation of laws.
d. Setting up billboards.
e. Dumping rubbish, setting up stalls, writing, painting, scribbling, constructing
structures on, under or above ground, hawking or conducting any other
activity for gain or otherwise.
f. Building bridges or erecting and or burying pipelines, cables and other
facilities that spans over or passes through expressway.
g. Adding a plane intersection on expressway.
h. Occupying and excavating or relocating the expressway for the purpose of
constructing other infrastructure projects.
i. Cutting down trees, uprooting plants or otherwise interfering with the

vegetation.
j. Destroying, stealing equipment or other acts of vandalism.
(2) Where a person commits any of the act or omissions described above, the person
shall be liable to compensate the company in accordance with the rates set out in
Appendix 2 for any damage caused to the expressway.
(3) If the prohibited act or omission does not cause damage to the expressway
property, the company may issue a cease-and-desist notice to the person. If the person
fails to cease the action or omission, the company shall in addition to any other legal
action report to police for investigation and possible prosecution.

3.5 Supervision of Construction within the Expressway Land Area


(1) Where any person intends to carry out construction within any part of expressway,
the person shall first apply for permission from the company.
a. The person shall submit a written application to the company in the format set
out in Appendix 8.
b. The application shall include the construction organization plan, the plan for
ensuring smooth flow of traffic in the construction section and the contingency
plan.
c. If the company approves the application, the company shall issue a written
approval for construction in the format set out in Appendix 9.
d. If the company does not approve, the company shall notify the person
applying of the rejection or request the applicant to correct and re-submit the
application.
(2) Before commencing construction, the applicant shall pay the company
compensation or occupation fee for the costs, expenses, disruptions, inconveniences,
and damages that will be caused by the proposed construction works.
(3) In addition, the applicant shall furnish a performance bond for such other damage,
inconvenience, and losses disruptions as may be caused by the proposed construction
works.
(4) The compensation shall be in accordance with the Compensation Standard set out
in Appendix 7.
(5) The company shall refund the performance bond in full if and only after the
construction is complete following the approval.
(6) Before issuing the approval, the company shall enter into an agreement with the
contractor authorizing the company to supervise the equipment, personnel involved in
the construction, site management, and progress of the works, corrective works and
any other matter that may adversely affect the expressway or its operations.
(7) In cases where the construction requires semi-range closure, the closure and re-
opening may be carried out only upon site inspection and approval of the company.

(8) In case the contractor fails to observe the terms and conditions for granted upon
approval especially the construction organization plan or the plan for ensuring smooth
flow of traffic in the section of the expressway affected by the construction, the
company shall serve a notice to the contractor to cease construction and or make
corrections.
(9) If the contractor refuses to make corrections, the company shall require the
applicant to cease construction, clear up the construction site and vacate the site.
(10) The company shall deduct the cost of making the corrections, and any other loss
or damage from the performance bond and refund the balance if any to the contractor.

3.6 Ensuring Smooth Traffic


(1) In case of traffic jams, construction works, severe weather, security protection or
other events disrupting the flow of traffic, the company will adapt to traffic control
measures including stopping vehicles, diverting vehicles to other routes or other
measures as the company may deem necessary.
(2) Where the company takes such traffic control measures, the company shall give
notice at the toll station entrance of the affected area and release real-time traffic
information updates on road information boards along the expressway and the
company website.
(3) The expressway is equipped with two real-time surveillance cameras per kilometer
to enable the company can quickly obtain traffic information about the road.
(4) The company inspection team shall be required to arrive at the accident scene
within 30 minutes after receiving information of an occurrence of an accident rescue
to deal with the traffic jam or traffic accident.
(5) The company is equipped with two wrecker trailers (6.8T), one truck crane (8T),
and two flatbeds (28.5T) to ensure that immobile vehicles from mechanical
breakdowns or accidents are quickly towed off the expressway to avoid obstruction of
traffic.
(6) The company shall cooperate with competent rescue service providers to ensure
that any obstruction to the road is quickly resolved and the expressway restored to
everyday use as quickly as possible.

4. Frequently Asked Questions

4.1 What to do if a traffic accident occurs on the Expressway?


(1) If an accident occurs on the Expressway and there are no personal injuries, death,
damage to property or the vehicle, the motorist shall,
a. Place a warning sign 150 meters from the vehicle on the side of incoming
traffic.

b. Move all the persons involved in the incident outside the corrugated beam
barrier
c. Notify the company of the accident through hotline number 0111039888.
d. Wait for the inspection team to arrive at the scene.
(2) If an incident causes severe damage to property, personal injury, or death or
making the vehicle defective the following procedure shall apply,
a. The injured persons shall be given first aid on scene and evacuated.
b. The scene of incident shall be sealed unless otherwise it is necessary to enter
into the accident scene to rescue the injured persons.
c. The motorist shall inform the company through the help hotline number
0111039888.
d. Wait for the inspection team to arrive at the scene.

4.2 How can one settle a claim for damage to the expressway in the

event of traffic accident?


(1) The parties concerned shall at first place the accident warning sign 150 meters in
direction of incoming traffic.
(2) As soon as possible, move to a place outside the corrugated beam barrier and call
the police and inform company.
(3) If the incident results in damage to the property of the expressway, the motorist
may settle the claim by paying the amount of money assessed by the company as the
compensation for the loss and damage including the cost of repairs.
(4) The company will issue a certificate showing the loss and damage and the
payment.

4.3 Are vehicles that exceed limits permitted on Nairobi Expressway?


(1) The entrances of the expressway have weighing bridges to detect vehicles that
exceed the weight limits.
(2) Where a vehicle exceeds the limits, the staff at the toll station shall direct the
driver not to use the expressway.
(3) If circumstances compel the company to allow the vehicle to be driven on the
expressway, the officers of the company shall escort the vehicle from the point of
entrance to the nearest toll station exit.
(4) The company will charge a separate toll for the expenses for the escort.

4.4 What are the formalities required to be handled before carrying

out construction on Nairobi Expressway?


(1) The contractor shall first make an application to the company.
(2) The application must be supported by the necessary permits, approvals, plan for
ensuring smooth flow of traffic on the section under construction, contingency plan
for responding to emergencies, and other necessary supporting documents.
(3) If the company approves the application with conditions, the company shall enter
into an agreement with the contractor by ensuring that the application meets all the
conditions for approval.
(4) The contractor shall not commence construction until he or she pays such fee as
may be charged by the company under the conditions need for approval and pay
performance bond.

4.5 Are the land areas and the spaces above and below the bridge of

Nairobi Expressway permitted to be used?


No entity or individual may occupy or carry out construction or perform any work
within the land area, building, and space below or above of the expressway bridge
without first obtaining written approval of the company.

4.6 What are the certificates required to be presented at the time of

payment and compensation?


(1) The motorist settling the claim for damage for the expressway may use his/her
own valid identity card, driver's license and other recognized identification documents
relating to him and or the vehicle involved in the accident.
(2) Motorists may settle the claim and pay the amount at the Expressway Property
Damage Claim Service Windows situated at the Expressway Service Center.

4.7 How can I pay for damaging the expressway?


You may pay by cash, bank transfer, card or M-Pesa, banker’s cheque or any other
method of paying. Personal and company cheques will not be accepted.

4.8 How can the traffic information on Nairobi Expressway be

rapidly obtained?
Access the official website of Nairobi Expressway: www.nairobiexpressway.ke; or
call the consultation and complaint hotline (0111039777) of the expressway which is

available for 24 hours each day.

4.9 What if the vehicle breaks down on Nairobi Expressway without

causing damage to the expressway property?


(1) If a vehicle breaks down on Nairobi Expressway and as a result it cannot be driven
and repaired within a short period so that traffic jam or safety hazards may be caused,
officers of the expressway will tow the vehicle to the exit of the nearest toll station or
a nearby designated parking area. The company will charge fee for towing.
(2) The company will issue invoice for the towing charges or issue invoice by a
towing service company commissioned by the company.

4.10 What is the procedure when vehicles damage the Expressway?


(1) Where an incident results in damage to the property of the expressway and the
vehicle becomes defective, officers of the company will deal with the vehicles
according to the obstacle removal and rescue procedure.
(2) If the driver agrees to immediately settle the claim of the company, the vehicle
will be towed to the place designated by the motorist after the police complete
inspecting the scene.
(3) If it is not possible to ascertain who is liable to compensate the company for the
damage, as certain the amount of damage or otherwise settle the claim at the scene of
the accident, the company will tow the accident vehicle to the nearest police station.
(4) Where a vehicle is involved in a traffic accident on the expressway and the person
involved flees the scene, leaving the vehicle unattended, the company shall tow the
vehicle to the nearest police station or expressway car park to avoid congestion and
traffic accidents.
(5) The fee for parking area shall be displayed in the parking area.
(6) The company will release the vehicle after the motorist pays the company for the
damage, towing charges and parking fees if any.

4.11 What if the driver refuses the towing services?


In cases where motorists refuse or otherwise obstruct officers of the company in
removing vehicles that obstruct the free flow of traffic in circumstances which can
create traffic jam or cause accidents the company may report the motorist to police to
take the necessary action. Which can include forcefully towing the vehicle to the
police station parking yard.

4.12 What if the driver causing the accident refuses or is unable to

settle the claim?


If the motorist fails or is unable to settle the claim for damage to the expressway
within 14 days following occurrence of incident the company may initiate civil
proceedings to recover the loss and damage.

4.13 What if the driver causing an incident flees the scene of accident?
Where a vehicle is involved in an incident that causes injury to persons, damage to
other vehicles or damage to the expressway but the motorist fails to stop and report
the incident to the company, the company shall report the matter to police for
investigation and prosecution.

4.14 Are pedestrians, motorcycles and low-speed vehicles permitted

on Nairobi Expressway?
The Nairobi Expressway is fully fenced. Pedestrians, livestock non-motor vehicles,
motorcycles, tricycles, tractors, crawlers, loader, and forklifts are not allowed on the
Nairobi Expressway.

4.15 Who is liable for injury to unauthorized pedestrians who enter

the expressway?
(1) Any person walking or driving a non-motor vehicle on expressway without
permission will be solely liable for any and all injuries, or deaths or losses suffered by
him or any other person.
(2) Motorcycles, tractors, wheeled mobile machinery, articulated passenger cars,
draw-bar trailer combinations and other motor vehicles whose maximum speed is
below 80 km/h are not permitted on Expressway.

Remark: Moja owns the right to finally interpret this Manual and will update
the contents when necessary.
