ORDER:-

The complexity of regulatory processes and the difficulty in compliance has been
cited as an impediment to the economic development. Department of Industrial
Policy and Promotion (DIPP), Ministry of Commerce and Industry (MoC&I),
Government of India (GoI) has taken up a series of measures to simplify and
rationalize the regulatory processes (registration and inspection processes) and
introduction of information technology as enabler to make governance more efficient
and effective. The DIPP, MoC&I in partnership with the World Bank Group, released
the Business Reform Action Plan (BRAP) 2017 for implementation by States/UTs on
13.04.2017. The BRAP includes 405 recommendations for reforms on regulatory
processes, policies, practices and procedures spread across 12 reform areas.
Obtaining Utility Permits is one among the 12 reform areas.

2. Accordingly, the following two initiatives are to be taken up for simplifying the
process of Road Cutting Permission / Right of Way permission to be accorded by the
Government under the reform area of Obtaining Utility Permits.
i) Design and develop an online system for granting road cutting
permissions in a manner that it allows online application submission,
payment, document submission and approvals.
ii) Define clear timelines mandated through the Public Service Delivery
Guarantee Act (or equivalent) legislation for approval of complete
application for granting Right of Way permission.

3. The Government now implements an ICT solution for Road Cutting Permission /
Right of Way (RoW) Permission application for the agencies. The objectives of the
application are as follows:

(i) Online submission of application for Road Cutting Permission/ Right of


Way Permission without the need of approaching any office
(ii) Online submission of relevant documents such as plans, Methodology
of cutting etc.
(iii) Online payment of fee for Road Cutting Permission/ Right of Way
Permission as applicable.
(iv) To provide permission within stipulated Service Level Agreements
(SLAs) i.e., within 21 days for road cutting permissions and 15 days
for ROW permissions.
(v) To facilitate the users to download the final signed approval
certificate online.
4. In view of the above, Engineer – In- Chief (R&B) Admn. SH, in the letter 3rd
read above, has requested to issue necessary orders for implementation of the
online Road Cutting permission/ Right of Way permission.

5. Government, after careful examination of the matter, hereby order the


following:
i. The online system will be operational for Industry/Public/Government
departments for use from the date of issue of this order and shall not to
accept any application and documents related to Road Cutting
Permission / Right of Way in physical form after 1st November, 2017.
Applications and documents submitted online will only be
accepted.
ii. Any Industry /Public /Government departments, whoever require
permission for Road cutting or for Right of Way shall invariably submit
their applications online.

iii. The applicant should submit the application form along with all the
necessary documents stated in the checklist and pay the fees online
itself for getting the approval. The road cutting or utilization of Right of
Way shall be done only after approval by the Department.
iv. Detailed Procedures, Checklist, Fees and Timelines shall be uploaded on
the web Portal “http://aprcrp.apcfss.in” as described below:

A. Procedure for Road Cutting / Right of Way Permission:

Visit online website for Road cutting / Right of Way permissions i.e. https://aprcrp.apcfss.in

First time Applicants need to register on website with their e-mail address as Login Id and
Password. Login details will be sent to registered mobile number as SMS & e-Mail. Registered
applicant then Logs in to submit his application Online.

Applicant fills the required details online and uploads the necessary documents and submits his
Application.

Executive Engineer verifies the application and assigns the application to DEE for verification if
the application is in order; otherwise the application will be returned to applicant. DEE will assign
to AEE. The AEE verifies and recommends to DEE and DEE recommends to EE for the final
Approval. Officers will be notified whenever an Application is forwarded to their Login for

On verification, approval will be accorded by the Executive Engineer and demand note will be
issued to the Applicant for payment of fee through online payment gateway

Applicant can track the status of his application in his login any time.

Applicant has to pay the Fee amount through Online Payment Gateway available on the Portal.

Fee payment acknowledgement will be generated and also communicated to Applicant.

Permission letter will be issued online and will be made available to Applicant to Download after
Fee Payment.
(B) Checklist for Online Application:

i) Covering Letter Requesting the Road Cutting / Right of Way Permission.


ii) Key Map showing the location of the Road Cutting proposed / Right of Way.
iii) Detailed Drawing showing the Road Cutting Plan / Right of Way required with
Clear measurements
iv) Detailed Plan and Methodology of Work.
Above documents are to be uploaded while submitting the online application.

The above fees are exclusive of GST and Centage charges. GST @ 12 % on
Restoration charges is applicable. Centage charges @ 16.5% will be added extra on the
total estimate, i.e., Road cutting restoration charges + GST. The restoration works will
be carried out entirely by the department.

The above rates are applicable for the year 2017-18. The rates will be revised
by 10% for every subsequent year on 1st April or as decided by the Government from
time to time.

The amount received towards Road Cutting restoration charges/Right of Way


permission fee shall be credited to the Government account.

(D) Timelines

a. Road Cutting Permission:


i) Application Scrutiny – within 3 days after receiving the Application
ii) Physical Verification by the Executive Engineer and Demand Note for Payment -
Within 14 days after receiving the Application
(iii) Payment of Fees by Applicant after issue of Demand Note – 2 Days
iv) Final Permission Letter Issued – Within 2 day after payment of Fees
Final Permission Letter will be issued within 21 Days of the Application
provided all application documents are in order and no delay in fee payment.

b. Right of Way Permission:


i) Application Scrutiny - within 3 days after receiving the Application
ii) Physical Verification by the Executive Engineer and granting Online Permission -
Within 12 days
Final Permission Letter will be issued within 15 Days of the Application provided all
application documents are in order.

6. These orders shall come into force with immediate effect.

7. The Engineer-in-Chief (R&B) Admn., SH, PPP, CP, EAP & MD, APRDC shall take
necessary action in the matter accordingly.
