AFFIDAVIT OF ADVERSE CLAIM
We, MASAYA E. AKO and MAKISIG E. AKO, both of legal age, both single, Filipino Citizens, and
residents of Sacyud, City of San Fernando, La Union, having been sworn to in accordance with law, hereby
depose and say that:
1. We are the children of the late SPS. DIWATA E. AKO and ENGKANTADO D. AKO, who at the time
of their death left a parcel of land situated at Sagayad, City of San Fernando, La Union more particularly
described as follows:
TAX DECLARATION NO. 23557
“A parcel of land containing an area of TWO HUNDRED (200) SQUARE METERES, more or less;
situated at Sagayad, City of San Fernando, La Union; designated as Lot No. 1234; Assessed at Php
2,000.00: Boundaries: North – Lot 5678; East: Lot 9101; South – Lot 1213; West: Lot 1415.”
2. We have another sibling named MAGANDA E. AKO who is currently residing at Purok 2, Sagayad,
City of San Fernando, La Union. Lately however, MAGANDA E. AKO now claims that she is the sole owner of
the parcel of land originally owned by our late parents . She also refused to let us possess the said parcel of land
and assigned another person to act as a caretaker thereof, thereby completely depriving us our rightful share on
the abovementioned property. Moreover she had already transferred the said property in her name by virtue of
Affidavit of Self-Adjudication which was covered by Tax Declaration No. 21-055-103557.
3. The said property was then sold to POGI N. CIATALAGA and is now covered by Original
Certificate of Title No. O-12345.
4. In order therefore to protect our rights over the abovemetioned property we hereby file our Affidavit
of Adverse Claim. And, unless an adverse claim is annotated on the afore-described Original Certificate of Title,
we are in danger of being deprived of our valid right over the subject property.
5. We are executing this Affidavit for the purpose of attesting to the truthfulness and veracity of the
foregoing allegations and to effect the annotation of the adverse claim in the original copy of OCT No. O-12345.
6. That this affidavit is executed to avail of the benefits of Section 70 of PD 1529 to publish the above
facts and to warn any third parties who may have intention to deal with the property covered by OCT No. O-
12345.
