References: » Oversight Committee on Illegal Drugs Meeting conducted on January 11, 2018; Memorandum to RDs, PROs 1-13, COR, ARMM & NCRPO re Encoding and Updating of Incidents in the CIRAS dated October 5, 2016; Memorandum to RDs, PROs 1-13, COR, ARMM & NCRPO re CIRAS Compliance Efficiency dated September 7, 2016; DIDM Investigative Directive Number 2015-02 “Quality Assurance Support to Vietms and Complainants (QASVC)" dated October 2, LOI 02/09 Unit Crime Periodic Report (UCPER) dated April 22, 2009; and | NAPOLCOM MC 94-017 re Adopting a Uniform Criteria in Determining When a Crime Considered Solved, dated June 2, 1994. o ° Fr @ 2. Rationale: It has been observed during the conduct of InbestigaTour 2017 that most crime incidents were not encoded in the Crime Information Reporting and Analysis System (CIRAS) by the Investigator-on-Case (IOC). The burden of encoding was instead relinquished to the Unit's Crime Registrar that resulted to poor encoding of facts of the case, were left unfilled. Moreover, the status of cases from the start of investigation up to the filing of criminal complaint to the prosecutor and the court were not reported nor updated. Hence, the reported Crime Solution (CS) is understated/inaccurate. 3. Purpose: This Directive reiterates previous Investigative Guidelines to emphasize consistency in the monitoring and updating of status of solved cases in the CIRAS. It provides mechanism on IOC to closely monitor the status of each criminal case assigned to them. Moreover, OC shall ensure that the relatives of every complainantvictim be notified periodically on the status of their complaint filed in court in compliance in the DIDM Investigative Directive No. 2015-02 “Quality Assurance Support to Victims and Complainants (QASVC). 4. Guidelines To ensure consistency in the monitoring and updating of status of solved cases in the CIRAS, the following guidelines must be strictly followed and implemented: a. Crime incidents shall be encoded in the CIRAS by the IOC immediately within 24 hours from the time of the occurrence of the incident using their personal account provided by Information Technology Division (ITD), DIDM; Updating of all cases should be done daily for submission of reports on the status of cases of solved cases in preparation for CPNP’s weekly press briefing; c. If the case was inquested, the case number, name of prosecutor, amount of bail, and other disposition of the complaint should be encoded; If the status is Released for Further Investigation (RFI), indicate the reason like: Non-Appearance of Apprehending Officer (NAAO) during inquest, No Attached Laboratory Exam (NALE), and other details that caused RFI; Include in the updating of the case if the relatives of the complainant/victim were notified on the status of complaint filed in court in compliance to the DIDM ID No. 2015-02 QASVC; Include in the encoding the updates of court proceedings like Arraignment, On-Going Trial, Warrant of Arrest Issued due to Non- Appearance of the Suspect/Witnesses, Final Resolution, Conviction, etc; f. Updates by the IOC shall include Dismissal of the Case due to Non- Appearance in Court of the complainant, witnesses, apprehending officers, and other contributing factors that cause the dismissal of cases; and g. Conviction of the Suspects due to Plea Bargaining shall be encoded indicating the detention of jail/prison term penalty and/or fined imposed by the court. s a 9 5. Responsibilities: a. Deputy Director, DIDM shall be responsible in supervising the implementation of this Directive; b. Executive Officer, DIDM shall assist the DDIDM in supervising the implementation of this Directive in coordination with concerned Directorates, NOSUs, PROs and other Offices/Units to ensure that updating of reports are executed. c. Chief, Crime Research and Analysis Center (CRAC), DIDM shall be the over-all OPR of this Directive; d. Chief, Case Monitoring Division (CMD), DIDM shall monitor the updating and timely reporting of all cases; e. District/Provincial/City Directors shall ensure strict implementation of this Directive. h. Chief of Police/Station Commanders shall strictly supervise the concerned IOC in the implementation of this Directives. 6. Adminisrative Sanction: The filing of administrative charges pursuant to NAPOLCOM MC. 2016-002 shall proceed against personnel who will refuse or take actions on the prescribed guidelines of this Directive. 7.
