RULING RE: PETITIONER'S EMEGENCY MOTION
The Court reviewed Petitioner's Emergency Motion for Temporary Restraining Order in
an Expedited Election Proceeding filed November 28, 2022. Petitioner seeks an emergency
order enjoining any certification of the canvass results of the November 8, 2022, election that
occurred in Maricopa County until hand count audits, signature verification audits, security risk
audits, and chain of custody audits can be properly assessed.
Petitioner's ability to request the relief contained in her Motion is premised upon A.R.S.
§16-672. That statute permits any elector to contest the election for multiple grounds, e-8.,
misconduct, illegal votes, including the ones alleged in Petitioner's Motion. However, such a
challenge, under Arizona law, shall be done “within five days after completion of the canvass of
the election and declaration of the result....” A.R.S. §16-673(A)(emphasis added). While
ARS, §16-673(A) applies to a state election, A.R.S. §16-674(A) directs that the same procedure
used to challenge a state election is to be used for a county election.

As the canvass and declaration of the results in Maricopa County for the November 8,
2022, election have not been completed, Petitioner's Motion is premature, This ruling is made
without prejudice to Petitioner's ability to file a similar and timely motion.
IT IS ORDERED denying Petitioner's Emergency Motion for Temporary Restraining
Order in an Expedited Election Proceeding, filed November 28, 2022, ‘This is a final judgment
pursuant to Rule 54(c), Ariz.R.Civ.P. No further matters remain pending.
IT IS FURTHER ORDERED signing this minute entry as a formal order of this Court.
