‘The Court finds this matter came before the Court on Tuesday, December 27, 2022, for
Competency Hearing,
Present in Court was Assistant Prosecuting Attomey Connie Lewandowski, and Defendant
represented by Attomey Mark Carfolo.
‘The Court finds the Competency Evaluation for Case 2022CR00474 shall be incorporated
with Case 2022CR00898,
The Court further finds the parties stipulate to the admission of the report from Psycho-
Diagnostic Clinic who opined the Defendant is not competent to stand trial but there is substantial
probability of restoration to competency within the statutory time if provided with a course of
treatment,
‘The Court further finds the Defendant is not competent to stand trial and can be restored to
competency within the statutory time frame if proved with a course of treatment in the least
restrictive treatment setting that is consistent with Defendant’s treatment needs and the safety of the
community and the Defendant's welfare.
IT IS HEREBY ORDERED pursuant to R.C. 2945.38(B) the Defendant shall continue
treatment at Twin Valley Behavioral Healthcare- Timothy B. Moritz Forensic Unit (TVBH-
‘TBMFU), a maximum security hospital, the least restrictive setting consistent with his treatment
needs and community safety, inpatient treatment for Competency Restoration under the supervisionSn
ofthe court evaluation unit. Inthe event the Defendant requires non-emergency medical care, the
Defendant is hereby granted Level 4 medical movement,
The Court will provide Twin Valley Behavioral Healthcare with all reports of Defendant's
current mental condition and the Prosecutor's Office will provide Twin Valley Behavioral
Healthcare with any other relevant information, including, but not limited to, a transcrip of the
hearing, copies of relevant police reports, and copies of any prior arrest and conviction records that
pertain to the Defendant and that the Prosecutor possesses,
ITIS FURTHER ORDERED as soon as the forensic examiner of Twin Valley Behavioral
Healthcare- Timothy B. Moritz Forensic Unit opines thatthe Defendant is ether competent to stand
‘wal or is unable to be restored to competency Twin Valley Behavioral Healthcare- Timothy B,
Moritz Forensic Unit shall provide the court with a written report reflecting said determination (see
R.C. 2945,38F). The written report shall be delivered by certified mail to the above captioned Judge
81203 W. Main Street, Ravenna, Ohio 44266. Further, the Sheriff of Portage County shall transport
the Defendant from Twin Valley Behavioral Healthcare- Timothy B, Moritz Forensic Unit to the
Portage County Jail upon notification that the Defendant is ready for transport.
