MEMORANDUM
2. On 19 May 2015 at around 7:20 am, witnesses Mr. Fernando Arellano y Dulce and Mr.
Leo Bakanis found a dead body located along grassy portion in Outlook Drive, Lualhati Brgy, Baguio
City. When witnesses are walking and get a pee on grassy portion, they found a male individual wearing a
green t-shirt, gray slack pant, and black rubber shoes lie supine position on grassy portion of the area.
They went near the victim and noticed no signs of life. The SOCO Team proceeded and processed the
crime scene led by PCI Julie Centeno where they found a Malathion pesticide bottle and a written
farewell note written in a piece of paper.
3. Initial finding of PSUPT Rodrigo Leal, victim dead for 8-12 hours and the cause of death
is multiple organ failure secondary to pesticide toxicity.

2. Investigation disclosed that the found cadaver was identified as Mr. Juanito Baltazar y
Quino, 34 years old, married, native of Quezon City, salesman at Sunrise Lumber and Construction, and a
resident of Purok 11, Irisan Dumpsite, Baguio City, currently living with his wife Mrs. Catrina Baltazar y
Jacinto, 28 years old, married, a native of Laoag, Ilocos Norte, works at Baguio’s Angel, Baguio City.
3. According to initial investigation, Mr. Juanito Baltazar found out that his wife is having
an illicit affair with his bestfriend Ricardo Carino, 30 years old, single, native of La Union, salesman at
Sunrise Lumber and Construction.
4. The farewell note found addressed to his wife expressing “mas mabuti nlng na mamatay
ako, para hindi ko nakikita ang pagtataksil mo. Masakit tanggapin ang ginawa mo dahil minahal kita ng
lubusan. Bakit mo nagawa eto, binigay ko lahat sau, ang aking puso’t kaluluwa.”
5. Based on the facts according to investigation of PSUPT Rodrigo Leal, the cause of death
of the victim is multiple organ failure secondary to pesticide toxicity.

I. AUTHORITY:
7. On 19 May 2015 at around 7:20 am, witnesses Mr. Fernando Arellano y Dulce and Mr.

transpired.
10. The further investigation confirmed that the cadaver was identified as Mr. Juanito
Baltazar y Quino, 34 years old, married, native of Quezon City, salesman at Sunrise Lumber and
Construction, and currently living with his wife Mrs. Catrina Baltazar y Jacinto, 28 years old, married, a
native of Laoag, Ilocos Norte, works at Baguio’s Angel, Baguio City.
IV. DISCUSSION:
11. According to initial investigation, Mr. Juanito Baltazar found out that his wife is having
a illicit affair with his best friend Mr. Ricardo Carino.

12. A farewell note written in a piece of paper addressed to the wife was found expressing
“mas mabuti na lang na mamatay ako, para hindi ko makita ang pagtataksil mo. Masakit tanggapin ang
ginawa mo dahil minahal kita ng lubusan. Bakit mo nagawa ito, binigay ko lahat sau, ang aking puso’t
kaluluwa.”
V. CONCLUSION:
13. The identified cadaver as Mr. Juanito Baltazar y Quino was able to be identified by the
wife upon arrival at the funeral.
14. Initial finding of PSUPT Rodrigo Leal presumed the victim dead for about 8 to 12 hours.
A farewell note was found at the crime scene expressing sympathetic farewell to commit suicide.
VI. RECOMMENDATION:
15. Wherefore, in view of the foregoing, the undersigned recommend this case is closed.

SUBJECT : Spot Report on Shooting Incident (transpired at WINE N ROSES
KTV BAR AND RESTO, first floor of MM. GARA Building, Km 4,
Marcos Highway, Bakakeng Central, Baguio City)
2. On 23 May 2017 at around 2:20 am, a gun shooting incident transpired at WINE N
ROSES KTV BAR AND RESTO, first floor of MM. GARA Building, Km 4, Marcos Highway,
Bakakeng Central, Baguio City, witnessed by the manager Mr. Isidro Estrada Balute, 46 years old born
on January 11, 1969, married, native of Sorsogon, a resident at no. 0407 Adiwang Road, Dontogan,
Baguio City, whereof victim Jay Viray Mojica, 29 years old, born January 14, 1988, married, sales office,
native of Imus, Cavite, and a resident TG Homes, Km 3, Marcos Highway, Bakakeng Central, Baguio
City, was shoot and hit on the right foot by the unidentified suspect. As a result, the victim immediately
rushed to Baguio General Hospital and Medical Center for immediate medical treatment rushed by the
suspect using his vehicle with license plate number of TOM 808.
3. The motive of the incident is clearly identified as misunderstanding between the victim
against the suspect since Mr. Mojica and wife with 3 town mates having a drinking fringe whereas the
suspect and company drinking coffee in another table and advised the latter to tone down their conversation
because they are noisy talking. The latter became annoyed and create misunderstanding between the two
groups.

2. Investigation disclosed that the unidentified suspects was identified as PO3 Efren Bayla
Lupak, 36 years old, born on March 5, 1981, married, PNP Member, native of Hungduan, Ifugao; and
PO3 Willy Galo Disme, 36 years old, born on November 2, 1980, married, PNP Member, native of
Lamut, Ifugao. Both suspects were the last persons to acquire the vehicle that had been sold for several
times to different buyers. Therefrom, the suspects are a member of Special Action Force (SAF) presently
assigned at RPHAU PRO-Cordillera, Camp Bado Dangwa, La Trinidad, Benguet, both residents at no. 2
Sto. Niño Road, Bakakeng Central, Baguio City, and formerly assigned at the camp Bagong Diwa,
Bicutan, Taguig City.
3. According to CCTV footage Mr. Mojica started the fight holding a pointed or bladed
weapon accompanied by his group who first attacked PO3 Disme.
4. On 27 May 2017, one of the suspects involved in the incident voluntary surrendered and
submitted his gun to his office described as: one (1) caliber 45, NORINCO, marked with BA 19621-08-
246 and with a serial number M1911 A1; and one (1) magazine for 45 caliber marked with J&J. Both
signify their voluntary and sincere agreement in peaceful settling of their issue without the benefit of
filing the case to court or other tribunal agencies therefore.
5. On 29 May 2017, the victim executed his affidavit of Desistance and Compromise
Agreement between the two (2) policemen.

IV. DISCUSSION:
12. In the follow-up investigation the recorded CCTV footage clearly indicate Mr. Mojica
started the fight holding a pointed or bladed weapon accompanied by his group who first attacked PO3

Disme. The license plate number of TOM 808 used by both suspects had been sold for several times to
different buyers.
13. Both suspects are a member of Special Action Force (SAF) presently assigned at RPHAU
PRO-Cordillera, Camp Bado Dangwa, La Trinidad, Benguet. One of the the suspect surrendered and
submitted his gun to his office described as: one (1) caliber 45, NORINCO, marked with BA 19621-08-
246, and with a serial number M1911 A1; and one (1) magazine for 45 caliber marked with J&J.
14. In this case both parties signify their voluntary and sincere agreement for settlement.
Afterwards, the victim executed his affidavit of Desistance and Compromise Agreement between the two
(2) policemen.
V. CONCLUSION
15. Filling a case is not necessary whereby both of the parties agreed to carry out a
settlement.
VI RECOMMENDATION
16. In view of the foregoing, althrough a compromised agreement between the parties
involved, the undersigned recommend that this case closed and settled.

2. On 03 November 2015 at around 6:00 am, witness Mr. Buenaventura Balneg y Espirito,
56 years old, married, BCPO Police Auxiliary, native of San Juan, Abra, and resident of Purok 11,
Bakakeng Sur, Baguio City, found a dead body with no means of identity located along Balacbac
Circumferential Road. The unidentified dead body is about 5’8’’ in height with a dragon tattoo on left
arm and “nato” on the right armpit. When the witness will fetch his motorcycle, he saw one black shoe
and bloodstains scattered at the side of the road near sidewalk and when he went to verify, he saw a dead
body of a person facing upward with both feet tied with packing tape and head covered with his colored
black jacket. The victim bore three (3) stab wounds at the abdomen and two (2) stab wounds at the throat.
The dead body was lifted by BFP (Bureau of Fire Protection)
Personnel led by SF03 Jayson C. Camero.

2. Investigation disclosed that the found cadaver was identified as Mr. Arnold Uminga y
Caubang, 42 years old, married, born on 14 May 1973 at Baguio City, and a resident at no. 88 Yap Street,
South Sanitary, Baguio City currently living with his live-in partner Marites Cabanacan y Misaya, 41
years old, single, born on October 7, 1974 at Catarman, Samar and a resident at no. 88 Street, South
Sanitary, Baguio City.

3. On 02 November 2015, according to the live-in partner of the victim Mr. Arnold Uminga
left their residence at around 7:30am. The brother of the victim Mr. Martin Uminga y Caubang, 39 years
old, born on March 16, 1976 at Baguio City and a resident at the said address also saw his brother at
about 3:00 pm of the same date at People’s Park leaving with an unidentified male companion. The live-
in partner came to know about the incident when she watched the news program of TV PATROL
Northern Luzon at 5:30 in the afternoon on 03 November 2015 when it was featured a found cadaver of
an unidentified male person along Balacbac Circumferential Road, Baguio City. The cadaver was brought
to Bahay Damayan Funeral Homes located at Km. 5, Marcos Highway, Baguio City
4. They went to Bahay Damayan Funeral Homes and was able to identify the victim’s
identity.

III. FACTS OF THE CASE:
7. On 03 November 2015 at around 6:00 am, witness Mr. Buenaventure Balneg y Espirito, 56
years old, married, native of San Juan, Abra, and a resident of Purok 11, Bakakeng Sur, Baguio City,
found a dead body at Rip Rap located along Balacbac Circumferential Road, Baguio City. The dead body
is about 5’8’’ in height with a dragon tattoo on the left upper arm and “nato” on the right armpit. When
the witness will fetch his motorcycle, he saw one black shoe and bloodstains scattered at the left side of
the road near the sidewalk and when he went to verify, he saw a dead body of a person facing upward
with both feet tied with a packing tape and head covered with his black colored jacket.
8. The responding Bureau of Fire Protection (BFP) personnel by SFO3 Jayson C. Camao
lifted the cadaver and no means of identification was recovered. The cadaver sustained three (3) stab
wounds on the throat confirmed by SPO1 Jepoy Ballong.
9. In the follow up investigation that the cadaver was identified as Mr. Arnold Uminga y
Caubang, 42 years old, married, born on 14 May 1973 at Baguio City, and a resident at no. 88 Yap Street,
South Sanitary, Baguio City currently living with his live-in partner Marites Cabanacan y Misaya, 41

PATROL Northern Luzon at 5:30 pm on 03 November 2015 where it was featured a found cadaver of
unidentified male person along Balacbac Circumferential Road, Baguio City. The cadaver was brought to
Bahay Damayan Funeral Homes located at Km. 5, Marcos Highway, Baguio City
11. The brother and live-in partner of the victim went to Bahay Damayan Funeral Homes and
was able to identify the victim’s identity.
IV. DISCUSSION:
12. On 03 November 2015 at around 5:35 pm the found cadaver was featured in TV PATROL
Northern Luzon found along Balacbac Circumferential Road, Baguio City.
13. Mr. Arnold Uminga left their residence on 02 November 2015 at around 7:30 am. The
brother of the victim saw him at about 3:00 pm of the same date with a male companion at People’s Park
14. In this case witness Mr. Buenaventura Balneg found the dead body facing upward with
both feet tied with packing tape and head covered with a colored black jacket at the left side of the road
near the sidewalk along Balacbac Circumferential Road.
15. Upon investigation on case that the cadaver sustained three (3) stab wounds on the throat
which his death confirmed by SPO1 Jepoy Ballong.
V. CONCLUSION:
16. The identified cadaver as Mr. Arnold Uminga y Caubang was brought to Bahay Damayan
Funeral Homes at Km. 5, Marcos Highway, Baguio City.
17. The proximate cause to the death of the victim was the three (3) stab wounds on the

throat. Therefore, the unidentified suspect is criminally liable for murder.
VI. RECOMMENDATION:
18. Wherefore, in view of the foregoing, the undersigned recommend for further
investigation to verify the identity of the unknown suspect.
