SYLLABUS FOR CIVIL PROCEDURE I.

For Academic Year 2022-2023

I. Course Description
This course is a study on the application of procedural laws in the
resolution of civil disputes, with emphasis on the jurisdictional
requirements in civil actions, Rules 1 to 39 of the 1997 Rules of
Court as amended by A.M. No. 19-10-20-SC.The course also
includes a discussion of the rules governing small claims,
appropriate modes of dispute resolution such as mediation,
barangay conciliation, etc. Applicable jurisprudence on the various
provisions shall likewise be discussed. Students shall also be
taught the relevant legal forms.

II. Reference
No required annotated book on Civil Procedure but be sure to have
a copy of the codal provisions.

III. Evaluation
Class Participation will be given 50 %. Midterm examinations will
be given 25% while the Final Examinations will be given another
25%.

FACTS: RTC 1.Municipality filed complaint for recovery of taxes against petitioner RTC. Filed
2 succesive motion for extension to file Res. Pleading granted, last day 2nd extension filed a
motion to dismiss ground on lack of Capacity and cause of action. MTD denied lack of merit and
improperly filed. Plaintiff filed the petitioner in default for having filed a motion to dismiss and
not a responsive pleading.

Issue: whether or not the motion to dismiss was seasonably filed. No, under R16 S1 of ROC
w/in time for pleading a motion to dismiss the action may be made on the grounds therein
enumerated.

RULE 11 SEC 1, SEC 4 RULE 16 allows the defendant to file an answer not only within
original 15 days period also w/a different period as fixed by the court.
