EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH WAIVER OF RIGHTS
KNOW ALL MEN BY THESE PRESENTS:
WE, heirs of late ANDRES CUEVAS LUNAR represented by LEILA L. ORTIZ LUIS, married
to Hanson C. Ortiz Luis, Filipino, of legal age and with postal address at One Sapphire
Condominium, 858 Fabella St. Brgy. Plainview Mandaluyong City, by way of Special Power of
Attorney (A copy of which SPA is hereto attached as “Annex A”)
ISABEL M. LUNAR, widow, of legal age, Filipino, with postal address at 65 Loreto Street,
Sampaloc Manila;
FLORENCIA L. MANDIGMA, Filipino, of legal age, married to Michael L. Mandigma, with postal
address at Blk 30, Lot 50 Paraguay St. Harmony Hills 1 San Jose Del Monte Bulacan;
REYNALDO M. LUNAR, Filipino, of legal age, married to Lucille G. Lunar, with postal address at
San Isidro Cuenca, Batangas;
LEILA L. ORTIZ LUIS, married to Hanson C. Ortiz Luis, Filipino, of legal age and with postal
address at One Sapphire Condominium, 858 Fabella St. Brgy. Plainview Mandaluyong City;
VICTORIA L. TUGADE, Filipino, of legal age, married to Bryan T. Tugade, with postal address at
162 Loreto St. Brgy. 417 Sampaloc Manila;
WHEREAS, ANDRES CUEVAS LUNAR died intestate on January 1, 2012, at San Isidro
Cuenca, Batangas, leaving an instate estate, a parcel of land situated at San Isidro, Cuenca,
Batangas and more particularly described as follows:

“Beginning at a point marked “1” of Lot 4926, Cad-610-D, C-14 being N. 82 deg.
58’E., 773.25m. from B.L.L.M. #1, Cad-610-D, Cuenca Cadastre; thence;
S. 08 deg. 02’ E., 33.37 m. to point 2;
S. 82 deg. 56’ W., 37.22 m. to point 3;
N. 05 deg. 50’ W., 71.96 m. to point 4;
N. 01 deg. 53’ E., 33.06 m. to point 5;
S. 10 deg. 04’ E., 39.23 m. to point 1;
Containing an area of TWO THOUSAND FIVE HUNDRED SIXTY-TWO (2,562)
SQUARE METERS.
All points are marked on the ground by PS.cyl. cons. Mons.
Bounded on the E., along line 1-2 by Lot 4922; on the S., along line 2-3 by Lot
4925; on the W., along line 3-4 by Lot 4924; on the N., along line 4-5 by Lot 4936; on the
E., along line 5-1 by Lot 5212 all of Cad-610-D, Cuenca Cadastre.”
WHEREAS, the above-named decedent left without any outstanding debts in favor of
any person or entity;
WHEREAS, we are the heirs of the above-named decedent, entitled to and have the
right to succeed his estate, particularly the above-described property, as being the legal wife
and legitimate children of the decedent;
NOW THEREFORE, for and in consideration of the foregoing premises and invoking Sec.
1, Rule 74 of the Rules of Court, we do hereby adjudicate unto ourselves the above-described
property.
WAIVER
That for the reason of love and gratuity, I, ISABEL M. LUNAR, is no longer interested in
pursuing acquisition of the aforementioned property and decided to WAIVE and TRANSFER all
my rights and interest in the aforementioned property stated above in favor of my children.
That I execute this waiver, freely and voluntarily to attest to the foregoing facts and
statements and for whatever legal purpose it may serve.
